| Madison County mother files suit over accident caused by tractor trailer |
| Posted By Zane Cagle |
 |
| A Madison County, IL woman filed suit earlier this month after she and her daughter sustained serious injuries in an accident involving a tractor-trailer.
The accident occurred on I-270 when the plaintiff had stopped due to traffic. Failing to stop his truck in time, the defendant struck the vehicle directly behind the plaintiff with enough force to push the plaintiff's car forward into another truck.
In the 4-count suit seeking over $200,000 in damages, the plaintiff alleges that the driver of the truck was negligent by driving too fast and failing to stop to avoid an accident.
The force of the impact resulted in serious injury to the plaintiff, whereby she experienced pain and suffering and incurred medical costs.
Auto accidents are dangerous enough, but the damages can be even more significant when larger vehicles like trucks and semis are involved. It is important you know your options for compensation, so do not hesitate to contact a lawyer. | Family gets $2.3 million after motorcycle crash involving officer |
| Posted By Zane Cagle |
 |
| The family of a motorcyclist who was killed in an accident involving a police offer won a $2.3 million verdict against the city named in the wrongful death suit.
At the time of the accident, the police officer was attempting to make a U-turn onto a highway and struck the motorcycle, killing the victim. The police officer suffered only minor injuries.
Although authorities found no criminal wrongdoing on behalf of the officer, the state Department of Public Safety issued him a ticket for an unsafe turn. The lawsuit used this as a basis for showing the officer was negligent and therefore, the city was also responsible for the officer's actions since he is an agent of the city.

| Brothers file suit against trucking company and drivers involved in fatal crash |
| Posted By Zane Cagle |
 |
| The brothers of a truck accident victim have filed suit in California this month against four trucking companies and the drivers involved in a fatal truck accident in November 2008 for the wrongful death of their father, younger brother and two others.
According to the suit, the brothers alleged that one of the defendants was driving a tractor trailer and rear-ended the victim, pushing his vehicle under the rear of another semi-trailer. Everyone in the vehicle was killed.
At the time of the accident, a dust storm had made visibility more difficult, and the suit alleges that tractor trailers should have been off the road that morning due to repeated broadcasts of the storm warnings and cautions of reduced visibility. Thus, the brothers believe the defendants' negligent and unlawful conduct is responsible for their family members' deaths.

The accident occurred on I-57 in Northern Illinois near Chicago when a semi-truck failed to observe a traffic stop, causing an eight-vehicle collision that killed one person an injured two others. Although no specific cause is known at this time, authorities believe the trucker may have been experiencing driver fatigue that affected his ability to pay attention.

| Couple sues crib manufacturer over death of 7-month-old son |
| Posted By Zane Cagle |
 |
| Last May, a young Louisiana couple experienced an ultimate tragedy when they awoke to find their 7-month-old baby boy had suffocated in a crib with a defective drop-side rail. When they found their son, he was wedged between his crib and the rail, with his face pressed against the crib's mattress.
This month, the couple filed suit against the crib manufacturer for negligence and product liability, alleging that the crib was defective and did not include a warning of potential suffocation.
The lawsuit claims that the defendant's conduct was the direct and proximate causes of the baby's death, and as a result, he suffered conscious pain and suffering when he died from suffocation. Additionally, the couple suffered the wrongful death of their child.
Damages sought include funeral expenses, loss of care, comfort and companionship, pain and suffering, medical expenses, and more.
Just weeks ago, the Consumer Product Safety Commission issued a voluntary recall of more than two million cribs made by this manufacturer after a total of four infant deaths occurred from the defective drop-side design. In response, the crib manufacturer has offered a free kit for parents to convert the cribs and eliminate the safety hazard.
If your family was affected by a defective product, do not hesitate to contact an experienced Product Liability Attorney. At Page Cagle in St. Louis, we will fight aggressively for your claim in order to get you the compensation you deserve. Call us today for a free consultation.

 |
| A San Antonio man died last week in a car accident after he attempted to pass another car on the right, injuring both his passenger and the driver of the other car.
After the man's SUV went off the road, he lost control and swerved into the path of the pickup he was attempting to pass. The two cars collided, and the SUV continued across the highway and hit a ditch, causing the SUV to flip several times.
The driver of the SUV died at the scene, but his passenger was taken to a local hospital in critical condition. Fortunately, the driver of the pickup sustained only minor injuries.
Due to the nature of the accident, the passenger and pickup driver could have a claim against the driver's estate if he is found to have been negligent or reckless. | Lawsuit filed after 3-year-old drowns in water park |
| Posted By Zane Cagle |
 |
| A water park in Ohio was sued last week for wrongful death over a tragic drowning of a 3-year-old boy in a park kiddie pool that occurred this past August.
The complaint alleges that the park failed to have enough life guards on duty the day of the accident, which was a violation the state had previously disciplined the company for in the past. According to the reports from police, emergency personnel and the park, the mother lost sight of the boy from her chair next to the pool and went to look for him. Unfortunately, lifeguards had already found the boy drowned in the water.
The plaintiffs in the suit firmly believe that more lifeguards would have prevented the accident, especially when considering that there were only 67 lifeguards responsible for the 250,000 square foot area, with only 5 watching the outdoor areas. Since 2005, the park has received four safety violations, most relating to the lack of lifeguards present at rides and attractions. Thus, the park had no excuse for the lack of guards the day of the accident.
If you were injured because of another's negligence or intentional act, you likely have a right to file a claim for legal compensation for any medical bills, lost wages, etc. Because each state defines a time limit for filing claims, it is important you do not hesitate to talk to a Personal Injury Attorney. At Page Cagle in St. Louis, our premier attorneys have expertise in a variety of areas, and we are available 24/7 for a free consultation. Call us today! |

| Hit-and-Run truck driver still on the loose |
| Posted By Zane Cagle |
 |
| Texas Police are still looking for the driver of an 18-wheel gravel truck that failed to stop after an accident last month that killed a 5-year-old girl.
According to newspaper articles, while on the way to school, the little girl was asleep in the back of her mother's Camaro with her brother. Suddenly, the truck collided with another vehicle in the oncoming lane, causing it to spin into the driver side of the Camaro and strike the vehicle precisely where the young girl rested her head.
The victim's mother said she saw the truck drive away as she attempted to help her daughter, but among the chaos of the wreck, did not get a good enough look to identify it.
Police investigators believe the gravel truck had attempted to swing out in front of the Mercedes from an outside lane, and the rear of the truck clipped the front of the Mercedes, which then caused it to hit the Camaro. As a result of the impact, the victim suffered a skull fracture and died at the hospital with her parents by her side.

| Excessive speed kills two teens in tragic one-car accident |
| Posted By Zane Cagle |
 |
| After conducting an investigation, authorities indicated that excessive speed was the cause behind a one-car accident that killed two teenagers, ages 15 and 17, last week in New York, devastating the youths' family and friends just two weeks before the start of the holiday season.
The Police made it clear that neither alcohol nor drugs were a factor, but it was clear that the male driver was driving too fast for the winding, rural road and lost control, skidding into a water-filled ditch and overturning into a tree. The impact of the car striking the tree killed the two teens in the front of the car.
A third passenger, another 17 year old male, suffered head injuries and was airlifted to a hospital in Albany. Fortunately, he was released the next day.
Car accidents are one of the leading causes of death among teens in the country and are often caused by a variety of factors. When injured in a car accident that was the result of another driver's negligence or recklessness, it is important to talk with a skilled Car Accident Attorney as soon as possible in order to ensure you are compensated for your injuries. | Falling accident in Illinois Hospital results in Wrongful Death Suit |
| Posted By Zane Cagle |
 |
| An Illinois plaintiff has filed suit in Madison County Illinois against a local hospital for wrongful death, claiming that the hospital's negligence lead to her mother's death.
According to the suit, the victim was hospitalized and classified as a fall risk, which prompted staff to attach a close call clip to her gown that would have notified them if she tried to leave her bed. However, the claim alleges the staff failed to attach this device properly, to properly inspect the bed alarm, and to enforce proper safety measures for this patient. As a result, the victim tried to get out of bed and fell, suffering injuries that led to her death one week later.
According to the FDA, falling risks are extremely high with regard to hospital beds, which is why many hospitals use devices like the one mentioned in this suit. However, by failing to attach these devices properly, nurses and other staff members can actually add to the danger of a patient receiving serious injuries from a fall. If you or a loved one was injured during a hospital stay because of the actions or failures of hospital staff, you may have a claim for compensation and should speak with an experienced Personal Injury Attorney right away. At Page Cagle in St. Louis, our premier personal injury attorneys are available 24/7 for a free initial consultation, so call today to begin discussing your options. |

| Pedestrian injured after falling 15 feet through metal grate |
| Posted By Zane Cagle |
 |
| A pedestrian in Maryland was rescued by city firefighers earlier this month after falling through a metal grate on the street, sustaining minor injuries.
Police investigation has not revealed the cause behind the grate collapse at of yet, but initial reports indicate that the pedestrian was walking on a downtown side walk when a grate gave way, causing him to plummet 15 feet below the street. He was trapped there for 30 minutes, and after the rescue, EMS transported him to a local Shock Trauma Center for medical care.
According to reports, the grate was more than 30 years old and its maintenance was the responsibility of the building owner at that address. Because of the permit contracts, however, Baltimore City is not liable for personal injury resulting from street grates.
In this situation, the building owner could be legally responsible for injuries sustained on his property. | Mother charged with DWI and manslaughter after crashing vehicle with 8 children in car |
| Posted By Zane Cagle |
 |
| A 31-year-old woman from New York was charged last week for driving while intoxicated, manslaughter, vehicular manslaughter, and assault after crashing her car with eight children inside. The crash killed an 11-year-old girl.
The tragic evening started with the defendant drinking cognac at a birthday party before loading up the children, including her own two children, in her station wagon for a sleepover. The father of her son, who was only 14 months, tried to stop her from driving and ended up pulling the boy from the vehicle.
When the defendant lost control of her vehicle, she was driving nearly 20 miles per hour over the speed limit. Five of the children were not wearing seat belts, and three of the children were in the back of the station wagon where there weren't any seats.
The young girl who died was one of the three girls in the back, who were all ejected onto the shoulder of the highway when the car crashed. One other girl remains in the hospital with serious injuries.
The victim's father said the maximum punishment for the defendant's crimes is not enough, and he blames the other parents at the party for allowing her to drive.
Although the driver is not expected to be arraigned until mid-November, she will likely face civil actions from the parents of the girl killed in the accident, and the other children who were injured. If you were injured or lost a loved one because of another driver was reckless or even negligent, you may have a claim for legal compensation for medical bills, lost wages and more.
