  Toddler and two others killed in two-car crash

Last Saturday, a two-car accident in Phoenix took the lives of a 3-year-old boy and two others.  

According to the Phoenix Police, witnesses saw the driver responsible for the accident speeding down the road when he struck a white Murano.  The toddler and another passenger in the Murano were ejected from the SUV and died at the scene.  The Murano's driver was taken to the hospital in serious condition.  

The passenger in the speeding car, a 19-year-old, also died.  The driver, however, sustained only non-life-threatening injuries.

  Construction workers call for safer conditions after deadly accident

Days after another fatal construction accident took the lives of three men in Austin, TX, a group of construction workers gathered outside City Hall, bringing with them one pair of boots for each of the 142 men and women who died in 2007.  

According to a report from the Workers Defense Project in Austin, more workers died in Texas that year than in any other state.

  Illinois man sues construction company over brain injury

In July 2007, the plaintiff sustained a traumatic head injury when the arm of a telescoping crane suddenly broke while he was working.  When the crane broke, it dropped its load of floor trusses, causing some of them to ricochet off other materials and strike him in the head and chest.

  Maine doctor killed in car crash involving 18-wheeler

A fatal car crash involving an 18-wheel tractor trailer in Maine last week took the life of the occupational health director at a hospital in Sanford.

According to Sanford Police reports, the doctor was killed late Tuesday afternoon when a truck struck her SUV on the driver's side while she attempted to make a left turn.  

The Police chief claims that obscurred vision due to a hill could have contributed to the accident, believing the truck crested the hill just as the doctor made the turn.  The crash remains under investigation with no charges filed as of yet.

  City faces wrongful death suit for woman's accidental electrocution

The city of Columbiana, OH faces a wrongful death suit along with two of its electrical workers over the accidental electrocution of a woman after she stepped into a puddle with an open wire on the street. 

The victim was only 39 years old when she set out to deliver newspapers one stormy morning in May 2004.  City workers had begun repairing a live wire on the street earlier that day, but left it hanging attached to a block and pulley system used to suspend the wire well above the ground. 

They did this to prevent it from being a harm to others, but with heavy rains, a puddle formed around the live connection.  When the woman stepped into the puddle, she was instantly electrocuted, and died as a result of her injuries.  The two workers who were working on the wire found her lying in the water.

Now, her family has filed suit against the city of Columbiana and the two workers in 2005, and it was re-filed in 2007.  A jury will decide whether or not the city was liable for the hazardous street conditions and alleged negligent actions of the two electrical workers.

The plaintiffs' attorney stated that the city workers made poor choices when they decided not to finish the job and suspend a live wire in the air during stormy weather.  Furthermore, they failed to place warning barricades around the site and to cut the electricity to that wire.  So, what happened to Smith was not so much an accident, but a tragedy caused by a series of poor choices.

  Missouri family files suit against drunk driver for father's death

Planitiff's from Waynesville, MO have filed a wrongful death suit after a drunk-driving accident that occurred on June 4.  

The defendant was driving on the wrong side of the road with a BAC of .214 when he struck victim's car and killed him. He was subsequently charged with first degree manslaughter.

Now, in the civil suit, the victim's children are asking the court to make defendant pay for funeral expenses and for the loss of companionship, comfort and support.

  Three-vehicle crash in northern Illinois sends two to the hospital

A serious crash in northwest surburban Elgin outside of Chicago sent two women to the hospital in critical care on Monday night.

Initial police reports stated that one of the drivers was heading northbound on Randall Road when she crossed the center line, striking a Cadillac Eldorado.

The crash sent the Cadillac spinning where it was struck by a third vehicle.

All three drivers were transported to St. Joseph Hospital, where two of them were later flown to a hospital in Downers Grove in critical condition.

So far, no charges have been filed as the accident remains under investigation, but the driver who crossed the center line could be held liable for the other driver's injuries.

  Construction company faces suit after employee causes car accident

A plaintiff from Godfrey, Illinois filed suit against a construction company after one of its employees rear ended her vehicle in May 2007.

As a result of the accident, the plaintiff sustained permanent injuries.  Since the other driver was an employee of the construction company and the accident occurred during the work day, the company could also be liable for her injuries.

According the the suit, plaintiff alleged she suffered disability, disfigurement, physical pain and impairment of enjoying her daily activities.  She claims that the other driver was negligent by driving too fast, and failing to keep his vehicle under control.

  Asbestosis spurs $1.4 million FELA suit in Illinois

Four former railroad workers have filed suit against five railroad corporations alleging that unhealthy and unsafe working conditions caused them to develop asbestosis and respiratory illness form second-hand smoke damage.

  Employer faces suit over "retaliatory discharge"

  Chicago Police officer kills 13-year-old boy on bike in hit and run

Last month, a Chicago Police officer was allegedly intoxicated when he struck a 13-year-old boy on a bicycle with his SUV in the early morning hours.  Instead of claiming responsibility for the incident, however, the officer fled the scene of the accident. 

Now, the family of the young boy has filed a petition with the court to determine liability for a wrongful death lawsuit.

According to police reports, the accident occurred on May 22.  The officer was taken into custody shortly after and charged with, "aggravated driving under the influence, reckless homicide and leaving the scene of the accident with death or injury."  He was also cited for transportation of alcohol and for driving in the wrong direction on a one-way street.

When other officers arrested him, they reported smelling alcohol on his breath but indicated he did not seem impaired after performing a field sobriety test.  According to the Cook County state's attorney, however, nearly four hours passed before he was given a breathalyzer test.

  Cahokia boy crushed by gravel truck, family files wrongful death suit

A plaintiff filed a wrongful death suit last week over the death of her grandson, who was killed while unloading a truck filled with gravel.  In her complaint, she names a truck driver, his employer and the quarry that filled the truck with gravel.

On April 25, the quarry company loaded the driver's truck with a little over 33,000 pounds of gravel.  The driver complained the truck was overloaded, but the company refused to remove the excess.

The driver, an employee for a construction company asked the plaintiff's grandson and one of his friends to help him unload the truck.  In return, he paid them each $5.  While unloading, however, the dump bed became unbalanced and tipped onto the boy killing him instantly.

The suit names the truck driver as directly liable for the boy's death since he both drove the truck and allowed unqualified workers to help him unload.  His employer is also named since the driver was working within the statute of his employment when the accident occurred.  Finally, the quarry could bear some responsibility since they allowed the truck bed to be overfilled, which may have contributed to it tipping over during the unloading process.

  Families fight for Workers' Comp benefits after radiation exposure

Years after being exposed on the job to radiation and toxic materials at an Ohio uranium enrichment plant, families of the exposed workers are fighting a state ruling that is keeping them from receiving workers' compensation death benefits.

  Tow truck causes four-car accident on interstate, kills one

This past Saturday, a four-vehicle accident involving a flatbed tow truck on an interstate outside Salt Lake City took the life of one man and stalled traffic for three hours.

The tow truck was southbound on I-15 and cross over a movable barrier, slamming into a northbound Toyota Camry, Chevy pickup truck and a Honda Element SUV.  The Camry became lodged underneath the tow truck, sending the driver to the hospital in critical condition.  The driver of the SUV was pronounced dead at the scene, and the two passengers of the pickup truck escaped major injury.

Initial Police reports state the accident was due to the tow truck driver "not paying attention."

  Wheelchair accident spurs premises liability lawsuit against city

A California family filed a wrongful death lawsuit last week against the city of Simi Valley over the death of a handicapped woman on a wheelchair access ramp.  According to the suit, the ramp violated building safety codes as well as Federal Americans with Disabilities guidelines.

The accident that spurred this suit occurred at a restaurant in March 2008.  While being pushed up the wheelchair access by her son, the victim fell with her chair off the side due to a lack of safety rails on the ramp.  As a result, she suffered a heart attack and brain injuries that put her in a coma for over a week.  She died earlier this year, having never fully recovered from the injuries she sustained from the accident.

The lawsuit alleges that since the wheelchair ramp was not in compliance with the American Disabilities Act accessibility guidelines for building construction or other safety codes, the woman's son was unable to maneuver around the ramp safely.

  Motorcycle-Semi accident kills soldier

Last week, a tragic accident involving and motorcyclist and a semi-truck took the life of a special forces soldier.

Although the accident is still under investigation, Colorado Springs Police reported that the accident occurred late morning when the speeding motorcycle lost control near the top of an interstate ramp and crossed a dirt shoulder into the eastbound lanes of traffic.  It was then struck by the truck, fatally injuring the motorcyclist.  The truck driver was not charged.

  Reckless teen driver kills 15-year-old passenger

The plaintiffs filed a wrongful death lawsuit this week against a teenager and his parents over the death of their daughter in a November 2008 crash in which the teen was driving.

The wrongful death lawsuit alleges the defendant drove recklessly, and his parents were negligent in allowing their son to borrow their vehicle, despite knowing he was an unsafe driver.

At the time of the crash, the defendant was only 16 years old and therefore had a limited driver's license, which prohibited him from having any passengers in his car other than an adult relative.  Furthermore, he had just received a speeding ticket for driving 48 mph in a 25 mph zone only months before. Despite all of this, the suit alleges that the teen's parents allowed him to borrow their pickup truck knowing that he was unfit to safety operate the vehicle.

Police reports indicate the defendant was under the influence of alcohol and was driving 62 mph in a 25 mph zone when he lost control of the truck causing it to roll.  Of the three people in the car, the plaintiffs' daughter was killed and one other teen was injured. 

The defendant pleaded guilty to involuntary manslaughter in February and sentenced to 6 months in youth detention.  He also lost his license until age 21 and will have to complete 500 hours of community service educating youth on the danger of speeding.

The plaintiffs' attorney stated that due to the defendant's criminal conviction in the case, the court has all the evidence necessary to impose civil liability as well.  The suit seeks unspecified damages that include punitive damages on behalf of the victim and her parents.

  Death in Hospital Emergency Room leads to $2 million lawsuit

A New York family recently settled a lawsuit for $2 million against a hospital in Brooklyn over the June 2008 death of a woman in the center's emergency room.

The suit alleges negligence on behalf of the city-owned hospital and emergency room staff who made the woman wait for nearly 24 hours for medical attention.  When her condition worsened before receiving her chance to see a doctor, she collapsed on the floor. Shockingly, no one attempted to help her, not even hospital staff who walked by.

A surveillance tape of the incident was released publically, receiving national attention and outrage.
