  Mother charged with DWI and manslaughter after crashing vehicle with 8 children in car

A 31-year-old woman from New York was charged last week for driving while intoxicated, manslaughter, vehicular manslaughter, and assault after crashing her car with eight children inside.  The crash killed an 11-year-old girl.

The tragic evening started with the defendant drinking cognac at a birthday party before loading up the children, including her own two children, in her station wagon for a sleepover. The father of her son, who was only 14 months, tried to stop her from driving and ended up pulling the boy from the vehicle.

When the defendant lost control of her vehicle, she was driving nearly 20 miles per hour over the speed limit.  Five of the children were not wearing seat belts, and three of the children were in the back of the station wagon where there weren't any seats.  

The young girl who died was one of the three girls in the back, who were all ejected onto the shoulder of the highway when the car crashed.  One other girl remains in the hospital with serious injuries.  

The victim's father said the maximum punishment for the defendant's crimes is not enough, and he blames the other parents at the party for allowing her to drive.

  Two-car accident kills one, injures another

A fatal car accident in Montgomery, AL took the life of a 62-year-old man last weekend, and severely injured another.

The victim was driving his car with one other passenger when he collided with a van.  Both he and the passenger were treated at a local hospital with life threatening injuries.  The victim died at the hospital a week later.

Details of the cause of the accident have not been released, but after investigating the accident, Police discovered the driver of the van was driving on a revoked license.  He was uninjured in the crash.

  Wrongful death suit filed against city for tragic ending to a police pursuit

The family of a Montana nurse killed by a drunk driver who was fleeing police has filed a wrongful death and negligence suit against the city and county where the accident occurred.  

The plaintiffs allege that the city police officers and county deputies violated official pursuit policies when chasing the drunk driver. Furthermore, the suit claims the two law enforcement agencies lied to the public, stating that the sheriff deputy called off the pursuit several blocks before the fatal collision in order to avoid liability.

  $49 million verdict for truck accident lawsuit in California

A truck accident victim out of California received a $49 million verdict last month for a traumatic brain injury he sustained as a result of the crash.

At the time of the crash, the plaintiff was a college student and was driving on a highway when two tractor trailers crashed.  Because of his severe brain injury, the plaintiff now requires 24-hour medical care.

  Southern Illinois plaintiff files FELA suit

A former employee of a major rail company has filed a FELA suit alleging injuries from repeatedly having to carry heavy objects.

Throughout his career, the plaintiff claimed he was forced to carry heavy, awkwardly shaped objects, to walk on uneven ballast surfaces, and to operate poorly maintained switches.  These practices resulted in a degenerative condition of his spine, causing the plaintiff to experience great pain, disability, mental anguish and a loss of income.

  Premises liability claim settles for $475,000

A plaintiff from Atlanta recently settled a premises liability lawsuit for $475,000 after he sustained injuries from a fall at a national car wash company.

The plaintiff worked for a company that supplied products to the car wash, and while at a service call, he fell though a fiberglass flooring grates in the car wash tunnel.  The cuts became infected from chemicals and contaminations in the runoff water, which resulted in several painful medical procedures.  The plaintiff also suffered permanent disfigurement.

His claim asserted that the car wash company failed to provide a safe working environment by having undetectable gaps in the fiberglass flooring grates.  He claims this dangerous condition could have been easily remedied with minimal expense, thus the car wash should have ensured worker's safety.

  Peoria teen injured in two-car accident

  Illinois man files FELA suit over work related injuries

A railroad worker from Southern Illinois has filed a FELA suit against his employer, claiming he suffered herniated discs and a hernia while working as a machine operator and trackman for a large railroad company.

When the injury occurred, he was attempting to remove a spike as instructed in his job assignment.  After his injuries, he had to undergo treatment and spinal surgery in July 2008.  He claims his back, neck, shoulder, arms, groin area, and hands were permanently impaired, costing him a loss of employment and medical expenses.

According to the suit, the defendant is guilty of many negligent acts, including its failure to provide the plaintiff with safe working conditions and failure to warn him of risks to which he is exposed.

  Chicago hospital sued over patient death for failure to diagnose

A Chicago hospital faces a wrongful death suit, filed last month in an Illinois Circuit Court, which claims that the hospital doctors and staff failed to diagnose bacterial meningitis.

According to the suit, the plaintiff went to the hospital seeking medical treatment for symptoms of headaches and vomiting.  Doctors and nurses gave him pain and blood pressure medication, and discharged him.  Found in his home unresponsive, he was transported back to the hospital on July 1, 2008, within a week of his original visit, where a CT scan showed brain swelling from meningitis. 

He died on July 3, and attorneys representing his estate filed this suit asserting that the doctors' failure to diagnose his condition directly led to his death.

  $1.4 Million verdict in Mesothelioma for widow of pipefitter

The widow of former pipefitter who passed away from Mesothelioma was awarded $1.4 million by a Tennessee jury in September.

The plaintiff's suit claimed that the defendant sold defective products to the company where her husband worked, which contributed to his diagnosis of Mesothelioma.  The plaintitff's husband worked as a pipefitter from 1952 to 1986, and during that time, he was exposed to asbestos contaminated products used by company employees.  

The jury deliberated for 2 days before returning a unanimous verdict in favor of the plaintiff, which her attorney stated was a victory for all Tennessee workers who were exposed to asbestos in the workplace by manufacturers who knowingly exposed them to the poisonous products.
