  Three-car crash injures five in Chicago

A three-car crash involving two taxi cabs and a car in Chicago injured five people, three were reported to be in serious condition after the accident.

According to reports, one of the taxis was t-boned by the car, causing it to strike a pole.  The car then collided with the other taxi.  When the emergency officials arrived, all the victims were down on the street, but police continued scanning the area to determine if any pedestrians were among the injured.

In all, three victims were reported as serious-to-critical and taken to local hospitals, and the other two sustained only minor injuries.

  Arizona Truck Accident lawsuit settles for $600,000

In Arizona, the parents of a college student killed by a semi-truck and the trucking company who employed the truck driver reached a $600,000 settlement earlier this month.

The accident occurred about an hour north of Phoenix when the victim ran over a dead elk that was lying on the road.  When he exited his vehicle, he was struck by the truck and killed instantly.

Although the police report found the trucker was not at fault, the plaintiff's attorney hired an accident reconstruction expert who concluded that the trucker had about 5 to 6 seconds to see the victim before hitting him but failed to apply the brakes at all.   This along with the trucking company's record of inadequate driver performance and history of pushing regulatory limits imposed on truckers motivated the defendant to settle with the family.

  Husband files wrongful death suit against Toyota after car crash

The husband of a woman killed when her 2009 Toyota Corolla suddenly accelerated and crashed filed a wrongful death suit against Toyota earlier this month.  This suit is only one of the entire slew of lawsuits Toyota is facing right now regarding defective car parts.

The victim died in a violent crash when her gas pedal stuck, causing her to drive through a stop sign and into a concrete wall

The plaintiff named Toyota and the dealership who leased the car for gross negligence, and he claims in the suit that the defective gas pedal existed at the time the product left the manufacturer's hands.

  EMS sued for wrongful death over death of athlete

In North Carolina, the parents of a high school football player filed suit against the Orange County EMS for wrongful death, claiming that the EMS responder failed to take proper care of their son.

According to reports, the 17-year-old teen came home from a football scrimmage and was experiencing severe cramping all over his body.  His parents were not home, so he called 911 for emergency service.

When the EMS arrived, the responder evaluated the teen for only 16 minutes despite the fact that the teen expressed his concern that he was severely dehydrated and requested an IV. The responder did not perform Orthostatics, an ECG, or take the boy's temperature.

Believing the condition was not serious, the responder did not take the teen to the hospital.  However, since he was only 17, he was required to have the the boy's parents sign the declination form.  The responder claims he attempted to call the boy's parents, but neither cell or home phone records reflect his assertion.

When the boy's parents returned home, they found their son unresponsive and not breathing on the living room floor.  He was pronounced dead on the scene.

Autopsy reports suggest that the cause of death could have been the result of the teen's cramping and past symptoms combined with dehydration, which may have led to a fatal cardiac event.

What it boils down to is that the EMS responder should have taken the boy's severe cramping and other symptoms more seriously and taken him to the hospital or provided an IV.  At least, the parents should have been notified of the boy's condition and the responder should not have let a minor sign a declination form.  The parents said it best: "He just left him there by himself.  He was just a child."

  West Virginia workers filed FELA suit against Norfolk Southern

Norfolk Southern was faced with two FELA suits last week by former employees alleging they suffered serious disabling injuries as a result of the rail company's negligence.

In one of the suits, the plaintiff was struck by another vehicle while on the job, suffering back, neck, leg and body injuries.  The plaintiff alleges that Norfolk bore the responsibility in that accident by failing to furnish him with appropriate equipment, including personal protective gear. Furthermore, the defendant failed to provide a reasonably safe place to work.

The other plaintiff made similar allegations against the company, but his injuries were the result of a train derailing that hit and collapsed a building that the plaintiff was standing on.

  Semi truck driver caused fatal accident while watching movie

A tractor trailer driver caused a fatal accident last week, and subsequent investigations revealed that his log books had been falsified and he had been watching a movie at the time of the crash.  

The driver admitted to police that he had been on duty for more than 27 hours prior to the accident and was watching a movie on a laptop when he struck another vehicle that was disabled on the road.  The driver of that vehicle died as a direct result of her injuries in the crash.

  Two Metro track workers killed in Red Line accident

Federal officials for the National Transportation Safety Board are investigating the deaths of two Metro employees in attempt to figure out why the driver of a Metro utility vehicle failed to realize the men were working behind him on the tracks.

This investigation comes on the heels of a long string of safety lapses and oversight failures on behalf of the transit agency, making many people wonder why these incidents continue unabated.

In the past seven months, five workers have been killed on the tracks despite safety rules that require Metro officials to keep all vehicle operators informed about the locations of work crews.  So far, many details surrounding this particular accident have not been made available to the public, such as how fast the car was moving when it struck the employees.

  Federal law bans texting for truckers and bus drivers

The federal government has banned texting for drivers of all large trucks and buses, with the hope that the new legislation will prevent deadly traffic accidents.  The new law went into effect immediately, imposing fines of up to $2,750 for violators.

Research that fueled the legislation cited studies that found heavy vehicle and truck drivers were 23 times more likely than a non-distracted driver to have an accident while texting and nearly 7 times more likely to crash while reaching for or using a cell phone.
