| Family of truck accident victim files suit against tollway authority |

| A Texas family filed a wrongful death suit earlier this month over a fatal truck accident on a Dallas tollway, naming the truck driver and a Texas toll company as defendants.
In the suit, the family alleges that the trucker was following too closely to another vehicle when he lost control of his truck and hit a median, causing a large piece of concrete to crash through the windshield of the victim's car in the opposite lane, killing him instantly.
The family also named a Texan highway toll company and other parties who were responsible for the engineering, construction or maintenance on the tollway.
In addition to civil action, the trucker was indicted for criminally negligent homicide, which is a state jail felony in Texas.

| Parents file suit against daycare over toddler's death |

| A tragic accident in 2007 took the life of a toddler when he fell into a septic tank outside his daycare center. This month, the parents have filed suit against the daycare, alleging negligence for failing to secure the tank's lid.
Investigation into the accident revealed that the tank's lid was damaged when a truck backed into it about a month prior to the toddler's death. The parents allege that if the daycare had repaired the damage, the toddler would not have fallen and drowned.

| Wrongful Death suit filed after Illinois pedestrian killed in accident |

| A wrongful death suit has been filed in Kane County, IL over a traffic accident that fatally injured a woman who was attempting to cross the road.
According to the suit, the accident occurred this past August around 10 a.m., and a 66-year-old woman was struck by a pickup truck driven by the 31-year-old defendant as she was leaving the post office. The complaint alleges the defendant failed to, "honk, drive safely, or pay attention." The defendant was also cited by police for failure to yield to a pedestrian and failure to exercise due care.

| Lawsuit filed against KU Fraternity after student dies from alcohol poisoning |

| The parents of a Kansas University student who died inside his fraternity house in 2008 filed a lawsuit against the fraternity and ten of its members earlier this month, alleging that the fraternity and its members did nothing to prevent underage drinking, and actually challenged the boy, who was a pledge at the time, to drink large quantities of alcohol. Furthermore, despite signs of, "obvious intoxication and a massive head injury," the defendants failed to seek medical help for the teen.
According to reports, the teen was found unresponsive in his bed at the fraternity house. Autopsy showed the victim had a BAC concentration of .362 percent at the time of his death, leading the coroner to conclude he died from alcohol poisoning.
In the four-count suit, the plaintiffs seek damages in excess of $75,000, a potion of which the family says they will donate to the university to educate student about hazing and alcohol consumption.

| Wrongful death suit filed against parents who provided alcohol to teen |

| In a wrongful death suit filed in Massachusetts over alcohol-related drowning, a mother alleged that two adults and five minors provided alcohol to her 17-year-old daughter on the night of her death.
The lawsuit alleges that the teen became "severely intoxicated" during the course of multiple parties on October 17, 2008 before wandering away from one of them and drowning in a nearby swamp. According to the plaintiff's attorney, the complaint primarily relates to the illegal provision of alcohol to underage drinkers, including the deceased, and allowing the teens to party at the defendant's homes.

| Moto Mart slip and fall case settled |

A hotly contested premises liability suit filed against a Moto Mart in Edwardsville finally settled last week, with the plaintiff's receiving just under $390,000.
The plaintiff alleged he was was seriously injured when he slipped and fell on the defendant's premises. His attorney asked the jury to award more than $2 million to the plaintiffs, but the judge ultimately directed the verdict before it could be decided on by jurors.
The settlement comes after much wrangling between the opposing counsels, and even an imposition of sanctions against the defendant for its conduct during discovery.

| Mother dies in fatal car wreck involving school bus |

| A school bus filled with an entire high school basketball team in Minnesota collided head-on with a car on an icy road last week, killing a 27-year-old mother and critically injured her husband.
Although the roads could have been the cause of the accident, authorities claim they are still looking into what caused the crash.
Fortunately, the bus passengers and a 3-year-old boy in the car were not seriously harmed in the accident, but the boy's father remained in critical condition on Friday.
Although this was a tragic accident, Authorities credit the outcome to driver of the bus, saying it could have been much worse if it weren't for how well he handled the snow and ice.

| Adolescent driver causes fatal crash |

| An 11-year-old boy was behind the wheel of a Honda Civic with his sister, mother, and one other in the backseat when he ran a stop sign, causing a tragic accident that killed his family and critically injured the passenger of the other vehicle.
What investigators are trying to figure out now is why the young boy was driving in the first place. According to those who knew her, the boy's mother was always, "very responsible and very involved," with her children. This observation made the fact that neither the mother or the younger sister were wearing a seatbelt even more shocking to friends of the family.
The driver of the other vehicle was fortunate enough to walk away from the accident, but the fourth passenger from the Civic remains in critical condition at a local hospital. | CPSC enforces new rules for baby product manufacturers after recalls |

| After several recent baby product recalls, the Consumer Product Safety Commission has imposed new regulations on manufacturers.
In a unanimous vote, the CPSC decided to require all manufacturers to keep track of product owners by providing consumers with postage-paid registration forms. The goal is to alert consumers about recalls faster, especially recalls which could be life threatening to infants and toddlers.
Just in 2009, millions of consumers were affected by three different recalls involving cribs, strollers and car seats. The CPSC is hopefully that the new regulations will help parents keep their children safe from defective products that pose direct dangers to their safety.

| A tragic semi truck crash in Georgia killed a three-year-old boy and severely injured the rest of the family when their minivan was rear ended.
According to news reports, evidence indicates that the truck driver didn't even hit his brakes before plowing into the van, going an estimated 70 mph. | Wrongful death suit filed after pharmacy error kills Michigan man |

| The family of a man killed in Michigan has filed a wrongful death suit after a pharmacy gave him the wrong dose of a drug and caused his death.
The suit alleges that the pharmacy was negligent in September 2007 when it filled a prescription written by the doctor for ten times the appropriate dose, causing the victim to overdose on the cancer treatment drug Temodar. The doctor was also named in the suit, but he settled with the family.
The family claims the pharmacy should have caught the error and contacted the doctor to clarify which dose was appropriate.

| Car crash kills one teen, injures four |

| A tragic car accident took the life of a teen driver, and injured four of his passengers last week when the teen bottomed out his Acura on a rural road, causing the car to spin out of control.
According to early reports, witnesses claimed the car was speeding extremely fast when they heard the car bottom out in a dip before twisting off the road, ejecting some of the five teens inside. Police estimate his speed to have been 85 mph, with a posted limit of 35 mph.
The driver was announced dead at the scene, while one of the male passengers was still in critical condition. Two female passengers were also transported to other hospitals with serious, but nonlife-threatening injuries.
