  Missouri Safe Boating Week
Posted By Zane Cagle

May 22-28, 2010 is Safe Boating Week in Missouri as proclaimed by Governor Jay Nixon in preparation for the Memorial Day Weekend and summer season.  About 700 deaths occur in the U.S. due to boat related accidents. Far more minor and catastrophic injuries are a result of boating and Jet Ski accidents as well.  Prevention is the best defense against such injuries and must occur before the boat ever enters the water.  The Missouri State Water Patrol offers several suggestions to keep you safe on the water this boating season:

Take a certified boating education course

Wear your life jackets

Do not consume alcoholic beverages while operating a boat

Be familiar with your boat and the equipment on board

Have a safety check of your boat before beginning the season

In order to get your boat safety inspected, you can contact the Missouri Water Patrol website for future safety inspection locations:  http://www.mswp.dps.mo.gov/News/NRDetailsbasic.asp?ID=N07100006  Each boat that passes inspection will get a "Wear It Missouri" sticker promoting campaign for life jacket use.

The Handbook of Missouri Boating Laws and Responsibilities is available at http://www.boat-ed.com/mo/handbook/checklist.htm.

Father and Infant Die from Crash into River Des Peres Water Channel
Posted By Zane Cagle
Despite heroic efforts by a local St. Louis man, a father and infant died after the father's car veered off River Des Peres Boulevard.  Todd Gilliam noticed the accident and rushed to assist the motorist in the sinking car. He had to wait a few minutes after he called for help so that someone could watch his own three year old daughter. Gilliam dove into the water channel and with the assistance of a police officer, they were able to cut the seat belt and free the father from the sinking car. No one was aware there was a seven month old  boy in the car as well. The infant drowned Wednesday as a result of the car submerging. The father never regained consciousness after sustaining serious injuries and died yesterday, four days after the accident. The auto accident and drowning is being investigated by St. Louis Police and as of now there is no reason to believe there were mechanical problems with the car. The reason for the auto accident is still unclear as the father was in apparently good health.

Train and Semi Crash Injures Four
Posted By Zane Cagle

A train and a semi-truck collided on May 14, 2010 in Michigan, and investigators are trying to determine if it was caused by driver error or malfunctioning railroad signals. The violent crash resulted in four people being injured. The train conductor, conductor assistant and an engineer were on board the locomotive at the time of the crash and the 59-year old driver of the semi-truck was alone. All four of the victims reported bruises, bumps and back pain.  As railroad accidents continue to increase involving derailment, crashes with other trains, pedestrians, equipment failure or crashes with other vehicles; all of these types of accidents can result in catastrophic injuries, deaths, and extremely large amounts of property damage.

National Dog Bite Prevention Week, May 17-23
Posted By Zane Cagle

Dog bites account for over 368,000 emergency room visits per year - that is approximately 1,000 per day. More than 4.7 million people are bitten yearly.  Dog bites are the fifth most frequent type of emergency room visits for children.

There are 10 good guidelines provided by the CDC. (Health New Digest) to follow in order to decrease your probability of being bitten by an unfamiliar dog and sustaining serious injuries:

  • Never approach a dog whether leased or unleashed. Overcome the urge to pet a dog just because it is near.
  • Teach children not to run at a strange dog or scream and wave arms wildly around a loose dog
  • Ask the owner if a dog is friendly before attempting to pet a leashed dog
  • Avoid staring directly into a dog's eyes, they frequently see this as threatening
  • Always allow a dog to sniff and see you before petting them. As well, keep the exchange short
  • Never leave children alone around a dog even if you think you know the dog
  • Dogs are like toys, they should not be climbed on or cuddled if you don't know them and think about it twice if you do know them
  • If a dog is approaching you, do not run away as this may trigger their prey instinct. Stand straight up with your arms folded. Turn slightly to the side and do not look the dog in the eye. Even if the dog is barking and jumping, they usually become disinterested in anything that is not moving
  • If a dog knocks you down, roll into a ball and try to be still. Cover your head with your arms. Avoid screaming or rolling as some dogs see this as playfulness.
  • Never approach a dog that is eating or playing with something or attempt to take the object away from the dog.

While these tips may decrease your probability of being bitten by a dog, it sometimes still occurs. Actually, dog bites are increasing in numbers partly due to lack of obedience training by owners.  If you have been injured in an animal attack and need compensation for medical bills, lost wages, etc., call us at the Cagle Law firm today.  Our premier St. Louis personal injury attorneys will speak with you personally in a free consultation, answering any and all questions you may have about your claim.

  Summer Swim Safety for Children
Posted By Zane Cagle

Drowning is the second leading cause of serious injury or death for U.S. children. Nine people drown every day in the US and 75% of the drowning occurs between May and September.  Many steps can be taken to prevent your child from drowning or sustaining a serious injury. Children don't just drown in swimming pool accidents. Children can drown in bath tubs, drainage ditches, and buckets as well. The most reasonable solution to safeguarding your children is by teaching children to swim. However, parents of even the strongest swimmers should gather strategies on safeguarding their children around water as to avoid injuries such astramautic brain injury or spinal cord injuries.

Some general safety rules include:

  • Children should never swim alone, even if they know how to swim. Cramps and fatigue can cause an accomplished swimmer to drown.
  • Always check the depth of the water before diving in.  Observe "No diving" or "No Swimming" signs
  • Swim in areas with a lifeguard, however, pools that are overcrowded can be very dangerous as the chaos can mask the danger.
  • If you give your children a flotation device as toy, it should never be a substitute for a PFD (personal flotation device).  Floaties and water wings should never replace the parent.

Some theories suggest that flotation devices should never be given to children so that they can become familiar with the properties of water and learn to swim more efficiently.

  • Do not allow your children to run as decks and concrete patios are often wet and slippery. Slip and falls for children can easily occur that would often seem small, however, children can fall quickly and the fall can result in a serious brain injury.
  • It is advised that NO DIVING should ever happen in an above-ground pool.
  • Keep a telephone outside close to the pool area, so you will not be tempted to leave the pool area for even a few seconds to answer the phone.
  • Keep chairs and tables far away from pool to keep children from accidentally falling in
  • Keep toys away from pool area as children can easily fall in trying to access the toys
  • Keep emergency numbers at the poolside telephone
  • Keep rescue equipment beside the pool at all times
  • Have children start swimming lessons early, but never think that after a few lessons that your child "can swim" or should be left alone to swim
  • Completely fence off the pool by using self-closing and safety latch gates.
While parents and caregivers implement as many safety precautions as possible the goal is to have many "fail safes".  This fail-safe idea  implies that a child may enter and pass one safety area;  but a second and third barrier will slow them down if you happen to look away for even a few seconds. Those few seconds can be the difference between a fun, safe summer and serious injury or death.  Summer is a fun, happy time and tragic serious injury accidents ruin the season and lives. If you have a loved one that was injured in a pool related accident, Zane Cagle at the Cagle Law Firm can assist you to determine if you have a claim or lawsuit.  Using a St. Louis attorney such as Zane Cagle allows you the resources to pursue damages and cover medical bills that are overwhelming after an injury.  At the Cagle Law Firm,  an experienced St. Louis  Accident Attorney can review your claim and help you file a lawsuit against the person responsible for your accident or injury or to help you to determine if you have a wrongful death claim.

Six Lawsuits Remain from House Fire that Killed Eleven
Posted By St. Louis Personal Injury Lawyer
One of seven wrongful death lawsuits was dismissed today when a plaintiff failed to appear in court in Neosho, Missouri. The seven wrongful death lawsuits were filed against a couple after the group home they operated burned and killed 11 people back in 2006.

The six remaining lawsuits were brought by the surviving family members of the people killed in the house fire. The couple who operated the group home has been named as co-defendants in the six remaining lawsuits. Authorities claim that the fire was most likely caused by electrical problems, and was ruled an accident, even though the actual cause may never be determined. The couple is also charged with federal counts of healthcare fraud and that trial is scheduled to begin this summer.

Deaths due to house fires can often be incidents of negligence, and when they are the survivors of family members of those killed can frequently retain damages for medical bills and other hardships.

If one of your loved ones has perished in a structure fire, and you think another person is to blame, contact St. Louis Personal Injury Attorney Zane Cagle to discuss your legal options and how he can help you take legal action after such a tragedy.
