  Four Year Old Killed in Four-Car Crash in Illinois

A four year old boy died after being involved in a four-car crash on the Northwest Side of Chicago Sunday morning.  The driver of the car in which the four year old and a two year old were riding rear ended another car in the first auto accident. The first car then crossed over to the next lane due to the impact and struck a third vehicle. The second car then struck a fourth car as a result of the first driver's actions. . The driver of the first car and the two year old were taken to area hospitals but information has not been released regarding any serious injuries.  At this time, investigators say the driver of the first car is in police custody and investigators are continuing the investigation.

  Work Zone Safety Examined After Recent Interstate Crashes

Recent automobile, tractor trailer and motorcycle accidents have brought highway work zones to the forefront of attention regarding safety.  According to safety engineer for the Missouri Department of Transportation, it takes a split second for disaster to occur while in or approaching a highway work zone.  Three recent crashes in work zones have made experts examine safety practices in road work zones.  Last Thursday evening a prisoner in a Wyandotte county sheriff's car was killed when the car was rear-ended as it slowed for construction on I-70.  This accident occurred just a week after a two teen fatality crash on I-44 that involved two school buses and serious injured several other teens.  On Sunday evening four people were seriously injured on I-35 when their car was hit from behind while it was stopped for work-zone congestion.  Some facts have been released about recent Missouri crash causes in work zones:

                Driver inattention is a major problem.

                Majority of accidents occur in the regular flow of traffic, not during rush hour

                Majority of crashes occur when it is drive.

  One Killed in Motorcycle-Car Collision

A man was killed in a motorcycle accident when he crashed into a car on Hampton Avenue at Milentz Avenue in St. Louis on Sunday.  He was traveling northbound on Hampton when the driver of a car hit another vehicle while attempting to pass which led to the collision with the motorcycle.   Two Teens Die and 54 Others Injured in Multi-Vehicle Accident on I-44

National Transportation Safety Board is investigating the Missouri crash in Interstate 44 that involved twoschool buses, a pickup truck and a tractor trailer.  The crash resulted in the deaths of two teenagers and injuries to fifty-four other students.  Two girls remain hospitalized; however, their names have not been released. The accident occurred when a semi slowed down for road construction and a pickup truck driven by a 19 year old man of Sullivan crashed into the back of it.  Two school buses carrying high school band students then slammed into that wreck.  A 15 year old girl of St. James, was killed when she was in the back seat of the first bus.  Charges will probably not be filed against any drivers until the final patrol reported is completed which may take up to six weeks.

Investigators are hoping to discover some information that will make school bus travel and road construction zones more safe.  Summer is a busy time for road construction and wrecks are common in work zones. The Missouri Department of Transportation is doing work on 250 bridges and improving 5,600 miles of roadway.  Accidents continue to happen in spite of their safety education efforts, signage, stricter penalties and fines for construction area violations.

  Amtrak Train Involved in Two Accidents in One Day

Amtrak train traveling from Lee's Summit to St. Louis was involved in two train-auto collisions with pick-up trucks on Thursday. At 8 a.m., a 44 year old man drove around a crossing bar that had just been lowered and was struck. The truck was sheared in half and the man was ejected about 40 feet.  The driver was rushed to the hospital with serious injuries and remains in intensive care. It was later determined that the driver was driving a truck that had been stolen earlier from a sanitation business. Then, two hours later, the Amtrak train struck a maintenance worker's pick-up as it was sitting too close to the tracks.  The maintenance worker was spraying weeds from the inside of the truck and did not have time to move.  The second collision occurred at a section of the track that did not include warning signs. None of the passengers on the Amtrak train were injured in either collision.

  National Misuse Rate of Child Safety Seats as High as 80%

Motor vehicle crashes are the number one killer of children ages 1-14.  While some crashes simply cannot be survived, over 57% of deaths for children 0-15 occur because the child was not restrained and many more occur due to the child being improperly restrained.  Nationally, the misuse rate of child safety seats is over 80% and as high as 95% in some areas.  Infant seats have been shown to reduce a child's fatal injury by 71% and toddler seats by 54%.

Due to a child's inexperience and lack of understanding toward many dangers, they are the most susceptible to death or injuries in a motor vehicle. Because of the increases in child fatalities in motor crashes, researchers have studied the causes of child injury during motor crashes and steps to help prevent them.

Harsh Grewal, MD, a pediatric surgeon from Temple University School of Medicine and Hospital in collaboration with his colleagues reviewed 10 years worth of medical literature on children and motor vehicle accidents.

Their study revealed that children involved in car accidents when they were inappropriately seat belted were at a higher risk for "seat belt syndrome", a complex of injuries to the spine and abdomen. Pediatric health care professionals should be wary when receiving children that exhibit bruising as it may indicate much more serious injuries such as spinal cord injury, abdominal and or spine tenderness and neurological deficits.  It was found that boys are more susceptible to injury than girls and that eh incidence increases with age.

There are some basic rules for child safety in motor vehicles from the Centers for Disease Control and Prevention:

  • Kids 12 and under should always ride in the back seat. This cuts the risk of death by 36%
  • Kids should be in a car seat or booster until they can be seated properly in a seatbelt.  For most children, this is around 8 years of age or 4'9" tall, but proper seatbelt fit is the most important factor.
  • Never place a rear-facing car seat in the front seat when there is an active frontal airbag.
  • Keep your baby rear-facing as long as possible. That can mean up to 30, 33 or 35 pounds in most current convertible seats unless they outgrow it by height first.
  • All current car seats should pass government safety standards. Select the one that best fits your child, your vehicle and your budget. Some models do have different features; select one that has the features that will allow you to use it correctly on EVERY trip.
  • Always read the owner's manuals for your vehicle and car seat thoroughly.  They often contain specific information about car seat installation that may not be obvious. Some models may vary from what you would expect.
  • Make sure the harness fits snugly on your child, the car seat fits snugly in your vehicle, and that your vehicle seatbelts are locked properly.
  • Why you buy a car seat, make sure you have a good return policy in case it doesn't fit or in case you find that you do not like it. Have your seat inspected by a certified technician for free at a checkup event or fitting station.
  • Please be wary of used car seats, especially those over 6 years of age, those with an unknown history that may have been in a crash, those that show any form of cracks or damage, and those with missing labels, model numbers, manufacturing date, instructions or parts.
  • Please give driving your complete, unimpaired attention and wear your own seatbelt all the time. These two simple steps are among these easiest ways you can protect yourself and your passengers from injury or death.

Obviously some restraint is better than none at all. In a collision, an unrestrained child continues at the speed of the automobile until they come into contact with some part of the interior.  On occasion, a car seat will be defective in its construction and may cause a child to sustain catastrophic injuries or even death.   Six Children and One Adult Injured in St. Louis

At least six children and one adult were injured in two car auto accident in North St. Louis. The driver of a van said she could not see the Mercedes as a bush in the median was obstructing her view.  The driver of the van was transported to the hospital as well as the six children who were passengers in the van.  The van struck a three-foot brick was that was attached to an apartment building.  Two of the children were transported to the hospital urgently with one possibly having critical injuries.  The occupants of the Mercedes refused treatment.

Spring and summer can sometimes be hazardous when foliage is in the peak of growing season.  Drivers must use extra caution at intersections when gaining a clear view ever mindful of landscape growth, motorcycles and bicycles.

  Teen Dies, Another Injured After Truck Overturns

An 18 year old teen died from injuries she sustained after a one vehicle auto accident.  The teen was a passenger in a truck driven by a 19 year old teen, both from Union, Missouri.  The 18 year old teen was thrown from the truck after it left the roadway.  The driver overcorrected, returned the truck to the road, and went off the road on the other side and overcorrected again, thus the vehicle overturned.

The teen was taken by helicopter to St. John's Mercy Medical Center but died later that afternoon. Police have not indicated if seat belts were being worn at the time of the accident. While seat belts are a great determinant between serious injuries and death in many cases, wearing them does not insure walking away from a crash with just minor injuries.  Investigators will need to conclude if seat belts were worn and if not, then could the injuries have been less catastrophic is worn

  One Dead after Head-On Collision in Madison County

A fifty-three old Collinsville man died after a two-car collision on Bluff Road in southeastern Illinois.   The man was driving a Chrysler Sebring and was northbound when he may have drifted into the southbound lane.  His car collided with a Toyota Celica that was driven by a 19 year old girl.  However, according to investigating officials, they are still trying to determine if it was in fact the man that drifted into the opposite lane.  The 19 year old girl was taken to a St. Louis area hospital with serious injuries.

  Woman Dies in Horrific Accident, "Texting" a Possible Contributer

A 21 year old woman crashed into a semi truck and was ejected from her car when she was then struck by a second tractor trailer on Sunday afternoon.  Officials pronounced the woman dead at the scene.  A witness reported that they had seen the woman texting just before the crash.  She lost control of her 2000 Oldsmobile Intrigue and left the highway, striking a guardrail. She then spun back into the highway and struck a tractor trailer. After crashing into the first tractor trailer, she was thrown from her car and then struck by the second tractor trailer. The crash remains under investigation and due to the damage to the car, it cannot be determined if she was wearing a seatbelt. However, her phone has been recovered for investigation as to time and use to determine if "texting" was a contributing factor in the horrific accident. No  reports were made in regard to the injuries the drivers of the tractor trailers may have sustained.

  10 Die on Missouri Highways Over Weekend

The Missouri Highway Patrol responded in nine counties to accidents that killed 10 people over the weekend.  Car accidents, motorcycle accident,bicycle accident, and a pedestrian hit and run were among the tragic events.  Twelve people died over the July 4th weekend and that number included local police agencies in addition to the Missouri Highway Patrol.  Therefore, this past weekend was more deadly than the last holiday weekend as there were 10 fatalities that the Missouri Highway Patrol worked alone. This number does not account for any injuries or fatalities reported by any local agencies.

First Crash: Saline County: A 27 year old man was struck and killed while walking along I-70 by a hit and run driver.

Second Crash: Cole County: Two Jefferson City men were killed in a head on car crash. Both men died at the scene. The 36 year old driver crossed the center line and crashed into the 30 year old driver. Both men were pronounced dead at the scene.

Third Crash: Franklin County where a 32 year-old St. Louis man died when the car he was driving veered off the road and overturned.

Fourth Crash: Greene County: An 87 year-old man died when he drove into the path of another car on US  Hwy 160

Fifth Crash:  Jasper County:  A 46 year-old man was riding a bicycle Saturday morning when he was struck from behind by a pick-up.  According to police, the driver of the pick-up never saw the bicyclist.

Six Crash: Clay County: A 44 year old-man and his passenger where thrown from their vehicle when it overturned after the driver proceeded to pass illegally.  The passenger sustained serious injuries.

Seventh Crash: Macon County:  A 31 year old man was thrown from his car after crossing the centerline, running off the road, striking a ditch, mailbox and cable box.

Eighth Crash: Buchanan County: A 25 year old man was killed on his dirt bike when he was hit by a southbound Jeep. He was not wearing a helmet according to patrol while operating his motorcyle.

Ninth Crash:  Newton County: A five year old girl died in a two-car crash on US 60, east of Neosho.  Eight additional people were injured, four sustained serious injuries.  According to patrol, a car ran a stop sign and pulled into the path of the car the five year old was a passenger.  Both cars went down an embankment. The child died at the scene and the driver other car is being investigated for blood alcohol.

  Two Injured in South St. Louis Crash

Two people were seriously injured after the car they were in crashed into a yard in south St. Louis.  Police report that the car collided into a truck before crashing into the yard.  Emergency personnel had to cut the car to remove the driver after the auto accident.  The driver and passenger were taken to a local hospital.  Their current status has not been released.

  Pedistrian Dies After Being Struck by a Car

A pedestrian has died after being struck by a car last Thursday.  The St. Louis woman was apparently running from a man chasing her on his bike when she was struck by the car.  She became stuck in the windshield and the car crashed into a restaurant drive-thru. She originally lost part of her leg and suffered multiple serious injuries which resulted in her death.   One of the passengers in the car was covered in broken glass and hospitalized.  Police are investigating the identity of the man chasing the pedestrian on the bicycle.  The pedestrian-auto accident occurred around 3 a.m. on Wednesday evening.  The St. Louis woman died on Thursday.

  Truck Driver Charged with Homicide with by Vehicle

A truck driver has been charged with homicide by vehicle in a deadly five car crash on Route 209 in Monroe County, Pennsylvania, that has killed one and left several others with catastrophic injuries. Last Thursday evening four vehicles were stopped at a red light facing northbound when the tractor-trailer traveling northbound in the right lane failed to stop and crashed into the back of a Mini Cooper. The Mini Cooper then struck a Chevrolet Corvette and then crossed the intersection and crashed into a guard rail.  The Corvette was pushed into the left lane and collided with a Chrysler 300. After striking the Mini Cooper the tractor trailer then continued straight and hit a Hyundai Santa Fe. The Hyundai was shoved into the intersection and the tractor trailer veered off the road and crashed into a traffic control pole and caught fire. The traffic control pole then fell on the Hyundai. The driver of the Hyundai and her passenger were air lifted to an area hospital.

The truck driver was arraigned on charges of homicide by vehicle, following too close, and careless driving.

  Driver Going Wrong-Way Crashes Into Tractor Trailer

A driver traveling in the wrong direction on I-70 crashed into a tractor trailer this morning near Kansas City. The driver was traveling west on an east bound lane.  Missouri Highway Patrol drew blood from the driver to check the driver's blood alcohol level, however, it is unknown at this time if there will be charges. The driver sustained injuries in the collision with the tractor-trailer and I-70 was closed for an hour for auto accident clean up.

  Illinois Truck Accident Kills Three and Involves Nine Vehicles

A chain reaction multiple car and semi accident occurred on Interstate 57 and three women were ultimately killed last weekend. According to the Illinois State Police several cars were slowing down to merge into one-lane traffic when a truck driver apparently got distracted and did not realize how fast he was going. He crashed into a Trailblazer, collided with several other cars and set off a chain reaction that involved nine vehicles in the fatal auto accident. The three women killed were all in the Trailblazer and were from Mississippi and on their way to visit an Illinois Amish community. They were almost to their destination when the multi-car and semi truck accident occurred. The accident happened about 135 miles east of St. Louis and 65 miles west of Terre Haute, Indiana.  When the local emergency teams responded to the scene they discovered that three of the four women in the SUV were dead. After being rear ended the Trailblazer went off the road and burst into flames, the driver sustained serious burns. An Equinox was also involved in the accident and was so destroyed that some oberservers thought it was upside down as they could not tell where the wheels A woman and her daughter actually were removed or crawled out. A woman sustained serious injuries, but the 11 year old daughter apparently crawled out and was walking around. Thirteen people were injured in the accident, two of which were critical. The interestate was closed from 5 p.m. until approximately 1 a.m. while road crews cleaned up the accidents.

  Six-Year Old Girl Killed After High-Speed Chase

A six year-old girl was killed when she was hit by a car involved in a Los Angeles Police high-speed chase.  Los Angeles Police were chasing a suspect they had witnesses making a drug deal. The suspect lost control of his car in a residential area and struck the little girl and pinned her against a stone wall. The tragic pedestrian accident occurred Thursday evening.  The six year-old sustained serious injuries and died at the hospital. Two passengers in the suspect's car were taken into custody; however, the driver fled the scene and has not been apprehended.  The officers witnessed the suspect flinging a gun from the car during the chase.
While criminal charges may follow against the driver and or passengers, there are also civil suit possibilities regarding wrongful death. Another possible claim is property damage. Families can file a suit for wrongful death due to the negligence of the drivers in this type of situation.

  Motorcyclist Dies After Crash

A Washington man is dead after he was struck from behind by a Camry as he was stopped on his motorcycle at a red light in St. Peters. The motorcyclist was sitting eastbound on Highway 94 at Kisker Road when an eastbound Toyota Camry struck him just after the light changed to green. The Washington man was thrown from his 2010 Triumph. The motorcyclist suffered catastrophic injures that led to his death. The police have not determined why the Toyota Camry re-ended the motorcyclist.

  Elderly Woman Dies and Two Injured in Two-Car Crash

A 90-year old St. Louis woman was killed Memorial Day in a two-car crash. She was passenger in a car driven by her granddaughter. Another passenger in the car was also injured.  The granddaughter was driving a Honda and attempted to make a turn and did not see the Jeep Grand Cherokee at the intersection of Interstate 70 and Ind 9.  The driver of the Cherokee said he was driving northbound on Ind. 9 from New Road when the driver of the Honda hit him. The Cherokee collided with the Honda's passenger side.  The St. Louis grandmother was air lifted to a local hospital and later died due to her catastrophic injuries.  The other two passengers in the Honda were treated for minor injuries due to the auto accident.

  Three Injured and One Dead in Dent County

Three people were seriously injured and one died as a result of an auto accident in Dent County. The truck was traveling north on Highway 19 when it hit a tree after running off the road. One resident of St. James died. The three passengers were airlifted to St. Louis hospitals with serious injuries. Two passengers are residents of St. James and one is a resident of St. Ann.

  Violent Motorcycle Accident Claims Life of 30 Year Old Man

    A Florida man was killed last Thursday night after a violent motorcycle accident. The victim was riding in group of motorcycles when he lost control and hit a light pole. His body was thrown from the motorcycle over an embankment and landed almost 350 feet in a yard below. The motorcycle continued down the highway for another 350-400 feet. It was a particularly gruesome accident as the victim's legs were missing after the impact.  Investigators state that the victim certainly died upon impact; however, they are still investigating the cause of the motorcycle accident and will be interviewing witnesses from the scene.   Father and Infant Die from Crash into River Des Peres Water Channel

    Despite heroic efforts by a local St. Louis man, a father and infant died after the father's car veered off River Des Peres Boulevard.  Todd Gilliam noticed the accident and rushed to assist the motorist in the sinking car. He had to wait a few minutes after he called for help so that someone could watch his own three year old daughter. Gilliam dove into the water channel and with the assistance of a police officer, they were able to cut the seat belt and free the father from the sinking car. No one was aware there was a seven month old  boy in the car as well. The infant drowned Wednesday as a result of the car submerging. The father never regained consciousness after sustaining serious injuries and died yesterday, four days after the accident. The auto accident and drowning is being investigated by St. Louis Police and as of now there is no reason to believe there were mechanical problems with the car. The reason for the auto accident is still unclear as the father was in apparently good health.

  19 Year Old Passenger Killed in Auto Accident

A 19 year-old has died from serious injuries he sustained following a one-car accident in Moniteau County, Missouri last week. The teen was a passenger  with a 20 year old driver who lost control of the car which crossed to the opposite side of the rural road, overturned and hit a tree.   First St Louis Auto Crash Fatality in May

A  St. Peters man was killed in an auto accident on Interstate 70 when the Dodge Durango he was driving was struck by the wheel of a tractor trailer.  Equipment failure caused the truck to lose two wheels from the rear axle. The wheel struck the front windshield of the victim's  Durango. After the collision, the Durango then traveled to the right and struck the side of a Nissan Altima in oncoming traffic on I-70. The driver of the Nissan was transported via ambulance to a hospital with minor injuries, however, the St. Peters man was pronounced dead at the site.  While this is the first fatality of May, it is the 44th  highway fatality of the year in the St. Louis area.

  Four Vehicle Crash in Illinois

A woman sustained serious injuries after colliding with a tractor-trailer in a four-car crash in Illinois last week. The woman was traveling northbound in the southbound lane of I-255 when she crashed into a tractor-trailer. After colliding with the tractor-trailer, she was struck by a van and a SUV that were traveling southbound on I-255. The woman was charged with drunk-driving, failure to reduce speed, and improper lane usage. The woman and the driver of the van were transported to the hospital.

  Two Women Injured in Head-On Crash

Trapped yesterday afternoon in cars were two women after a head-on crash in Arnold, Missouri. The auto crash occurred at Interstate 55 and Highway 141 after an elderly woman entered traffic into the southbound lanes from a northbound lane.   Mother sues White Sox and Chicago bar after hit-and-run

The mother of university student in Illinois filed a wrongful death lawsuit against the Chicago White Sox and a Chicago bar over the death of her daughter in a hit-and-run accident, claiming both establishments allowed her to purchase and consume alcohol prior to her death.

The plaintiff's daughter was only 20 years old last year when she attended a White Sox game with a group of friends.  She was served alcohol at the game from stadium vendors and later went to defendant's bar that night.  After leaving the bar, she was hit by a car while attempting to walk home intoxicated.

In her 18-count suit, the plainitff cites wrongful death, negligence and the Illinois Dram Shop Act.  First, the vendors at the game failed to check Lech's identification and allowed a minor to consume alcohol.  Second, the bar and its owners were negligent in allowing an intoxicated minor into the bar and for possibly over-serving the patron who fatally struck her daughter with his car.   

At the time of her death, the daughter had a BAC level of .23, nearly four times the legal limit to drive.  From her injuries, it appeared she had been either kneeling or sitting on the roadway.

  Dump truck plows into motorcycles, kills 3

According to the Associated Press, a group of eight motorcycle riders was stopped at an intersection when a dump truck failed to stop and plowed into the back of the group, killing three riders.

Some of the bikes caught fire under the truck while others were scattered behind it.  

So far, no details have been released on why the truck driver failed to stop.  He could be held liable for damages to the injured riders and the victim's families if found to have been negligent or reckless.

  School bus crashes with car, injures three

Three people had to be flown from a scene of a bus accident after sustaining serious injuries in a head-on collision.

A witness said the car lost control and went over a grass median, driving into opposite traffic.  It barely missed her vehicle before colliding head on with a school bus full of students.

  Child who died in car crash not in car seat

A toddler died in a car accident earlier this month in a two-car accident that sent five people to the hospital.

The state Highway Patrol said that the child was not in a child car seat or wearing a normal seat belt when the car he was riding in stalled on the highway.  An SUV, unable to avoid the collision, slammed into the car, fatally injuring the toddler, who died two days later from head trauma.  

According to reports, the driver of the car, and mother of the child, had been ticketed twice for failing to restrain a child in a car seat.

  Family files $5million suit after truck accident

The family of a bicyclist who was killed in a collision with a truck filed a wrongful death suit for $5 million against both the trucker and his employer.

The accident occurred when the victim was riding his bicycle behind the truck.  When the trucker turned right, the victim became caught in the truck's rear wheels, killing him instantly.

  Three-car crash injures five in Chicago

A three-car crash involving two taxi cabs and a car in Chicago injured five people, three were reported to be in serious condition after the accident.

According to reports, one of the taxis was t-boned by the car, causing it to strike a pole.  The car then collided with the other taxi.  When the emergency officials arrived, all the victims were down on the street, but police continued scanning the area to determine if any pedestrians were among the injured.

In all, three victims were reported as serious-to-critical and taken to local hospitals, and the other two sustained only minor injuries.

  Mother dies in fatal car wreck involving school bus

A school bus filled with an entire high school basketball team in Minnesota collided head-on with a car on an icy road last week, killing a 27-year-old mother and critically injured her husband.  

Although the roads could have been the cause of the accident, authorities claim they are still looking into what caused the crash.

Fortunately, the bus passengers and a 3-year-old boy in the car were not seriously harmed in the accident, but the boy's father remained in critical condition on Friday.

  Adolescent driver causes fatal crash

An 11-year-old boy was behind the wheel of a Honda Civic with his sister, mother, and one other in the backseat when he ran a stop sign, causing a tragic accident that killed his family and critically injured the passenger of the other vehicle.

  Car crash kills one teen, injures four

A tragic car accident took the life of a teen driver, and injured four of his passengers last week when the teen bottomed out his Acura on a rural road, causing the car to spin out of control.

According to early reports, witnesses claimed the car was speeding extremely fast when they heard the car bottom out in a dip before twisting off the road, ejecting some of the five teens inside.  Police estimate his speed to have been 85 mph, with a posted limit of 35 mph.

  Madison County mother files suit over accident caused by tractor trailer

A Madison County, IL woman filed suit earlier this month after she and her daughter sustained serious injuries in an accident involving a tractor-trailer.

  St. Louis man killed in accident on I-70 Christmas Eve

A man was killed in an accident on I-70 in St. Louis Christmas Eve morning after being hit by a pickup truck driver who lost control and struck him while the man was outside his vehicle.

  Family gets $2.3 million after motorcycle crash involving officer

The family of a motorcyclist who was killed in an accident involving a police offer won a $2.3 million verdict against the city named in the wrongful death suit.

  Hit-and-Run truck driver still on the loose

Texas Police are still looking for the driver of an 18-wheel gravel truck that failed to stop after an accident last month that killed a 5-year-old girl.

According to newspaper articles, while on the way to school, the little girl was asleep in the back of her mother's Camaro with her brother.  Suddenly, the truck collided with another vehicle in the oncoming lane, causing it to spin into the driver side of the Camaro and strike the vehicle precisely where the young girl rested her head.

The victim's mother said she saw the truck drive away as she attempted to help her daughter, but among the chaos of the wreck, did not get a good enough look to identify it.

  Excessive speed kills two teens in tragic one-car accident

After conducting an investigation, authorities indicated that excessive speed was the cause behind a one-car accident that killed two teenagers, ages 15 and 17, last week in New York, devastating the youths' family and friends just two weeks before the start of the holiday season.

  Illinois tractor trailer accident kills one and injures another

  Multiple-car accident sends several to the hospital

A man was sent to an Ohio hospital after running a red light and causing a multiple-car crash last week. 

According to Police, the driver was attempting to pass on the right while three cars were stopped for a red light at an intersection. After passing, the driver veered left and struck a Honda Civic that was turning left.  This caused the driver's Mercedes to crash into two other vehicles both traveling in the opposite direction.  With the initial impact, the Honda Civic ended up crossing four lanes of traffic before hitting a parked car and an office building.

  Mother charged with DWI and manslaughter after crashing vehicle with 8 children in car

A 31-year-old woman from New York was charged last week for driving while intoxicated, manslaughter, vehicular manslaughter, and assault after crashing her car with eight children inside.  The crash killed an 11-year-old girl.

The tragic evening started with the defendant drinking cognac at a birthday party before loading up the children, including her own two children, in her station wagon for a sleepover. The father of her son, who was only 14 months, tried to stop her from driving and ended up pulling the boy from the vehicle.

When the defendant lost control of her vehicle, she was driving nearly 20 miles per hour over the speed limit.  Five of the children were not wearing seat belts, and three of the children were in the back of the station wagon where there weren't any seats.  

The young girl who died was one of the three girls in the back, who were all ejected onto the shoulder of the highway when the car crashed.  One other girl remains in the hospital with serious injuries.  

The victim's father said the maximum punishment for the defendant's crimes is not enough, and he blames the other parents at the party for allowing her to drive.

  Two-car accident kills one, injures another

A fatal car accident in Montgomery, AL took the life of a 62-year-old man last weekend, and severely injured another.

  Two injured in 3-car crash in Montana

A three car crash near Great Falls, Montana sent two people to the hospital and slowed traffic for more than an hour last week.

Involved in the accident was a dump truck, a green SUV, and a gray car.  According to witnesses, the dump truck had stopped to turn left off the highway and turned on his blinker.  The SUV also stopped behind him, but the gray car never braked, hitting the SUV at 65 to 70 miles per hour.

  Tractor-trailer accident kills mother and two daughters

A fiery head-on collision with a tractor-trailer this past Tuesday took the lives of a woman and her two daughters, ages 4 years and 12 weeks.

Witnesses who saw the tragic accident reported seeing the woman's car cross the center line of a two lane highway, right into the path of an oncoming tractor-trailer.  The car then burst into flames, sending bystanders running for fire extinguishers.  

Once the flames were put out, a witness who stopped to help told reporters he cracked the back window to let the smoke out of the vehicle.  That was when he and the police saw the two girls in the back seat.

The witness's wife, a registered nurse, began giving the baby chest compressions, but unfortunately the infant and girl sustained fatal injuries and were pronounced dead at the hospital.

Police are still investigating the accident, and no charges have been filed.

  Woman killed while working at roadside hot dog stand

Last week, a freak roadside accident in Tampa took the life of a woman working at a hot dog stand with her business partner, who was also injured in the accident.  According to a Tampa newspaper, the woman wanted nothing but to run her own restaurant, which was why she moved to the city with her family to start a new life.  

On Monday, the woman and her friend's husband were set to open a hot dog stand on a busy Tampa avenue.  That afternoon, the woman was securing a sign when her business partner heard her scream.  Seconds later, he was pinned under the metal tongue of a runaway trailer that had detached from a pickup truck and careened toward their stand.  

The man was transported to a local hospital immediately.  Police reports indicate that a riding lawn mower tumbled off the trailer, striking striking the woman as she attempted to run away.

  Jury awards family $4.4 million for fatal accident

A Salt Lake City family received a $4.4 million award verdict over an accident that took the life of their father in 2006 when he attempted to swerve around stopped traffic, running into other vehicles.

At the time of the accident, the interstate was under construction and traffic had slowed to a stop.  As the the man approached the crest of a hill, the car in front of him saw the traffic and slammed on his brakes.  He then tried to swerve and crashed, dying from his injuries two weeks later.

According to the family's suit, the state Department of Transportation and the subcontractor working on the bridge reconstruction failed to post adequate warnings about traffic delays.  The family's attorney stated that he may have known about the construction, but he did not know where the traffic was backing up.

After hearing the facts in the case, the jury returned a unanimous verdict in favor of the plaintiff, apportioning partial blame to both the state and the subcontractor, totaling almost $4.4 million in damages.  The jury did find that the man was twenty percent liable for the accident, but the suit prompted the state to reevaluate its traffic safety regulations.

  Truck Driver sentenced for fatal accident

As reported in a Maine Newspaper, a truck driver was found guilty for leaving the scene of an accident last year after losing his load of wood beams from his trailer, killing a motorist.

While driving on a winding section of road in January 2008, the trucker lost the beams which then struck a man's vehicle.  The trucker claims he did not realize he was involved in an accident until he returned to the scene looking for his wood.  He saw the emergency vehicles, but said firefighters blocked him from accessing the road.  

When asked if his load could have caused the accident, he told officers no.  The Assistant District Attorney stated that by not cooperating with the investigation, the trucker failed to "right his wrong."  

Although the trucker admitted his mistake in not owning up to his role in the accident initially, he insists he never intended to leave the scene.

  New York tow truck driver hits car while on two cell phones

Earlier this month, a New York tow truck driver admitted to police that he had been texting on one cell phone and talking on another when he crashed into a car driven by a 68-year-old woman with her niece.

After hitting the car, the driver then crashed into a residential swimming pool.  

Although the woman and her young niece suffered non-life threatening injuries, the truck driver could still face legal consequences.

  Mail carrier responsible for hit and run

Three weeks ago, a mail carrier in California was involved in a hit and run accident in which he pulled in front of a car driven by a 17-year-old boy.   

At the time, the mail carrier was attempting to make a left turn, but made the turn too early pulling out directly in front of a car.  The boy driving the car swerved to avoid the collision, running into a ditch and colliding with a tree and a parked truck.

Although none of the boy's injuries were life-threatening, he did sustain a number of cuts and deep bruises as well as lacerations from his seat belt.

The mail carrier did not stop after causing the accident to help the boy out of the car.  Instead, he offered police two different stories about the incident.  First, he claimed he didn't realize he caused a crash until a bystander stopped him.  Second, he said saw the boy drive into the ditch, but did not see him hit the tree or car so he drove away thinking the other driver was alright.

According to police, however, regardless of which story is true, the mail carrier can be charged with a hit and run for leaving the scene of an accident.  Since he drove negligently, he is also responsible for the boy's injuries and medical expenses.

  Spike in accident deaths involving motorcycles this year in Illinois

According to Illinois State Police, accidents are on the rise this year, up 54% in some counties compared to last year.  

What is causing the increase?  Alcohol and speeding are among the leading factors, but authorities also noticed how many of these fatal accidents involved motorcycles.

  Three Columbia residents seriously injured in car accident

A three-car accident in Missouri early Tuesday morning on Interstate 70 sent three Columbia residents to University Hospital in serious condition.   

According to Missouri State Highway Patrol, a 19-year-old woman was driving the wrong way on Eastbound I-70 and struck another vehicle head-on.  Initial reports indicate she was under the influence on alcohol.  

The teen driver was arrested on suspicion of driving while intoxicated, driving on the wrong side of the highway and five felony counts of vehicular assault for each of the five people involved in the accident.

  Victims of car accident sue drunk driver and Schnucks

Four Illinois residents filed a 12-count lawsuit in Madison County this month over a drunk driving accident that sent them all to the hospital with upper body injuries.  

The plaintiffs' were riding in a car when the defendant failed to yield at an intersection and struck the vehicle.

As a result of the collision, all four people incurred medical expenses and lost wages and experienced pain, suffering and disability.  Their suit claims that defendant was negligent and under the influence of alcohol which impaired his driving.

The suit also named Schnucks under Illinois' Dram Shop Law, making them liable for selling him the alcohol he consumed before the accident.

  Drunk driver strikes construction worker outside Chicago

According to Illinois State Police, a drunk driver struck a construction worker last weekend, pinning him between two cars, while the man was on a road construction site in south suburban Dolton, IL.

The driver and worker's names were not released, but police reports indicated the accident happened around 4:15 a.m. when the driver of a Cadillac entered a protected work zone and struck the man.  

The worker sustained two broken legs after being pinned against the Cadillac and a van. Both men were transported to local hospitals.  

As of yet, no charges have been filed against the drunk driver, but he could be held liable for his negligent driving in a civil suit.  The construction worker could file a claim to receive compensation for his medical bills and loss wages while recovering from his injuries.

  Motorcyclist injured in accident involving semi truck

Last week, a traffic accident in Pennsylvania involving a semi truck and a motorcycle left one man injured after being dragged nearly 15 feet under the front bumper of the truck.

At the time of the accident, both vehicles were waiting to turn left at an intersection.  The driver of the truck claims that he did not realize he hit the motorcycle from behind until he noticed several bystanders waving in attempt to get his attention.  

Witnesses say the bike and driver were stuck under the truck's bumper and dragged several feet.  Fortunately, the motorcyclist's injuries were not severe.

  Drunk driver kills passenger in one-car accident

The morning after the July 4th holiday, Syracuse Police responded to an accident involving a single vehicle that crashed into a bridge abutment.  

According to initial reports, the driver of the vehicle had a blood alcohol level of .23 percent, nearly four times the state's legal limit.  The driver admitted to officers at the scene that she had, "tons of alcohol," and was driving too fast when she lost control.  

Her passenger was pronounced dead at the scene, and driver was taken to University Hospital for her injuries.  

Due to the nature of the crash and her BAC level, the driver has been charged with a DWI and second-degree manslaughter for the death of her passenger.  The passenger's family could file a wrongful death lawsuit against the driver for her negligent and reckless driving.

  Truck driver reports she "dozed off" before causing crash that killed family of four

A deadly accident between an 18-wheeler and a van killed a family of four last week in Mississippi.  The driver of the truck told police that she "dozed off" before plowing into the back of the van at a red light.

After rear-ending the van, the truck drove over the vehicle, causing it to roll and eject one of the passengers.  The van then hit another vehicle before coming to rest on its side.  All four passengers were declared dead at the scene, including two young children, ages 12 and 14.

Federal regulations restrict drivers to 11 hours of travel for every 14-hour period before having to rest.  So far, driving records for the trucker are not available, so it is unclear how long she was on the road.  But, she could face a grand jury for negligence and vehicular homicide.  Likewise, the relatives of the family killed could file a civil suit against the trucker and her employer for wrongful death.

  Toddler and two others killed in two-car crash

Last Saturday, a two-car accident in Phoenix took the lives of a 3-year-old boy and two others.  

According to the Phoenix Police, witnesses saw the driver responsible for the accident speeding down the road when he struck a white Murano.  The toddler and another passenger in the Murano were ejected from the SUV and died at the scene.  The Murano's driver was taken to the hospital in serious condition.  

The passenger in the speeding car, a 19-year-old, also died.  The driver, however, sustained only non-life-threatening injuries.

Planitiff's from Waynesville, MO have filed a wrongful death suit after a drunk-driving accident that occurred on June 4.  

The defendant was driving on the wrong side of the road with a BAC of .214 when he struck victim's car and killed him. He was subsequently charged with first degree manslaughter.

  Three-vehicle crash in northern Illinois sends two to the hospital

A serious crash in northwest surburban Elgin outside of Chicago sent two women to the hospital in critical care on Monday night.

Initial police reports stated that one of the drivers was heading northbound on Randall Road when she crossed the center line, striking a Cadillac Eldorado.

The crash sent the Cadillac spinning where it was struck by a third vehicle.

All three drivers were transported to St. Joseph Hospital, where two of them were later flown to a hospital in Downers Grove in critical condition.

So far, no charges have been filed as the accident remains under investigation, but the driver who crossed the center line could be held liable for the other driver's injuries.

  Construction company faces suit after employee causes car accident

A plaintiff from Godfrey, Illinois filed suit against a construction company after one of its employees rear ended her vehicle in May 2007.

As a result of the accident, the plaintiff sustained permanent injuries.  Since the other driver was an employee of the construction company and the accident occurred during the work day, the company could also be liable for her injuries.

According the the suit, plaintiff alleged she suffered disability, disfigurement, physical pain and impairment of enjoying her daily activities.  She claims that the other driver was negligent by driving too fast, and failing to keep his vehicle under control.

  Chicago Police officer kills 13-year-old boy on bike in hit and run

Last month, a Chicago Police officer was allegedly intoxicated when he struck a 13-year-old boy on a bicycle with his SUV in the early morning hours.  Instead of claiming responsibility for the incident, however, the officer fled the scene of the accident. 

Now, the family of the young boy has filed a petition with the court to determine liability for a wrongful death lawsuit.

According to police reports, the accident occurred on May 22.  The officer was taken into custody shortly after and charged with, "aggravated driving under the influence, reckless homicide and leaving the scene of the accident with death or injury."  He was also cited for transportation of alcohol and for driving in the wrong direction on a one-way street.

When other officers arrested him, they reported smelling alcohol on his breath but indicated he did not seem impaired after performing a field sobriety test.  According to the Cook County state's attorney, however, nearly four hours passed before he was given a breathalyzer test.

  Tow truck causes four-car accident on interstate, kills one

This past Saturday, a four-vehicle accident involving a flatbed tow truck on an interstate outside Salt Lake City took the life of one man and stalled traffic for three hours.

The tow truck was southbound on I-15 and cross over a movable barrier, slamming into a northbound Toyota Camry, Chevy pickup truck and a Honda Element SUV.  The Camry became lodged underneath the tow truck, sending the driver to the hospital in critical condition.  The driver of the SUV was pronounced dead at the scene, and the two passengers of the pickup truck escaped major injury.

Initial Police reports state the accident was due to the tow truck driver "not paying attention."

  Motorcycle-Semi accident kills soldier

Last week, a tragic accident involving and motorcyclist and a semi-truck took the life of a special forces soldier.

Although the accident is still under investigation, Colorado Springs Police reported that the accident occurred late morning when the speeding motorcycle lost control near the top of an interstate ramp and crossed a dirt shoulder into the eastbound lanes of traffic.  It was then struck by the truck, fatally injuring the motorcyclist.  The truck driver was not charged.

  Reckless teen driver kills 15-year-old passenger

The plaintiffs filed a wrongful death lawsuit this week against a teenager and his parents over the death of their daughter in a November 2008 crash in which the teen was driving.

The wrongful death lawsuit alleges the defendant drove recklessly, and his parents were negligent in allowing their son to borrow their vehicle, despite knowing he was an unsafe driver.

At the time of the crash, the defendant was only 16 years old and therefore had a limited driver's license, which prohibited him from having any passengers in his car other than an adult relative.  Furthermore, he had just received a speeding ticket for driving 48 mph in a 25 mph zone only months before. Despite all of this, the suit alleges that the teen's parents allowed him to borrow their pickup truck knowing that he was unfit to safety operate the vehicle.

Police reports indicate the defendant was under the influence of alcohol and was driving 62 mph in a 25 mph zone when he lost control of the truck causing it to roll.  Of the three people in the car, the plaintiffs' daughter was killed and one other teen was injured. 

The defendant pleaded guilty to involuntary manslaughter in February and sentenced to 6 months in youth detention.  He also lost his license until age 21 and will have to complete 500 hours of community service educating youth on the danger of speeding.

The plaintiffs' attorney stated that due to the defendant's criminal conviction in the case, the court has all the evidence necessary to impose civil liability as well.  The suit seeks unspecified damages that include punitive damages on behalf of the victim and her parents.

  Southern Illinois crash kills 4, injures 5 over Memorial Day weekend

Although Memorial Day is supposed to be a relaxing holiday weekend, it is also infamously known for fatal car accidents.  The Associated Press released an article this week describing only a few of the fatal crashes that occurred all over the country this weekend. 

One of those tragic crashes occurred in Southern Illinois just after midnight near Keyesport, IL, where a two-vehicle crash took the lives of four people and sent five more to the hospital.  According to the coroner, three of the victims were pronounced dead at the scene after being ejected from their vehicles, and one died later at a St. Louis hospital.

The accident occurred at the intersection of Emerald Road and Keyesport Road when a Pontiac Grand Am failed to stop at the stop sign. As a result, it collided with a Cadillac Escalade as it entered the intersection.  The crash caused the SUV to hit a drainage ditch and overturn. 

The Escalade had seven passengers total, three of which were killed.  Every passenger except one was only 21 years old.  The passenger in the Grand Am was also pronounced dead at the scene.

So far no charges have been filed, but police reports did confirm that the driver of the Grand Am was largely at fault for failing to stop at the intersection.  Witnesses, however, put at least some of the group in the SUV at Carlyle Lake earlier that day.

  Motorcyclist killed by distracted driver

Among the constant string of reported car accidents in the news lately concerning drivers not paying attention due to cell phones or car radios, comes another case in Illinois of driver distraction taking the life of a motorist.

A Lake Zurich resident was killed while stopped at a yellow light on her motorcycle when the woman behind her failed to stop because she was painting her nails.  The motorcyclist was wearing a helmet, but unfortunately it was not enough to protect her from the force of the crash after flying several hundred feet.  The woman that hit her stopped to help, and she later admitted to police that she did not see her stop since he was looking down at her nails.

  Illinois woman files suit over multi-car accident on I-57

Elizabeth Jackson filed suit this week, alleging that a multi-car accident caused by David Jack and Brian DeAngelis left her with severe injuries that affect her daily life.

In November 2008, DeAngelis, who was working for KD Express at the time, rear-ended Jack while driving an International Ha Trucktractor in the northbound lanes of I-57.  Jack was driving a Chevy Impala, and crossed the median into the southbound lanes where he then crashed into Jackson's Dodge Charger.  Jack died as a result of his injuries.

In her three-count suit, Jackson alleges that DeAngelis was negligent in failing to reduce his speed and by striking Jack's car.  She also claims that Jack was negligent by traveling below the posted minimum speed limit.

Jackson says she suffered permanent pain, mental anguish, disability and disfigurement, as well as an inability to attend to her usual duties.  She also seeks compensation for medical expenses and lost wages.

  Family reaches $1.2 million settlement with Laidlaw over son's death

After years of litigation, the Pippenger family finally came to a settlement with Laidlaw, Inc., now First Student.

In December 2005, Brandon Pippenger, age 13, crossed the street to try and catch the morning bus to school.  Running late, he ran alongside it, waving his hand to get the driver's attention.  According to company regulation, buses are supposed to stop no less than 100 feet from a corner.  That morning, not only did the driver not check his mirrors but he also turned the corner without stopping.  Not seeing Brandon, the bus ran him over as it turned.

Brandon's mother Patty watched the whole thing in horror.  To this day, all she wanted was for Laidlaw to admit their responsibility for what happened.

The case would have ended last March, but the court ordered that the two parties settle out of court.  Confronted with all the facts pointing toward the driver's fault in the tragedy, Laidlaw finally agreed to settle with the family for $1.2 million.

"From the start, we wanted people to know that Brandon did not cause his own death.  He did not slip and fall under the bus," says Pippenger of Laidlaw's defense in the case.  With the settlement, it was made clear that the driver's error was the real cause for Brandon's death.

Text messaging has become the new topic of debate in cell phone usage while driving as the occurrence of texting-related accidents is on the rise. 

In what many have called a social epidemic, text-messaging among young teen drivers in particular has many officials quick to draw up new legislation banning the practice.  U.S. News and World Report recently published an article about this very topic, stating that about 20% of drivers text while driving, a statistic that jumps to 66% when 18-24-year-olds are isolated. 

Although no one knows the percentage of accidents caused by texting, more and more accidents today attribute the cause of the crash to an inattentive driver who was either texting, checking voicemail or dialing. 

Cell-related crashes have become so prevalent that legislators in five states have banned hand-held cell phone usage while behind the wheel.  Washington and New Jersey expressly prohibit driving while texting (DWT).  So far, 16 states are considering similar legislation that will either outlaw or restrict the practice, and 24 states are deciding on whether to ban talking on cell phones as well.

Some of the reasons mentioned in the article for why texting has become popular among all age groups is the increased sophistication of phones that cater to texting abilities through the use of touch-screens or full keyboards.  The danger obviously is that too many drivers are looking down at their phones instead of the road.

  Man sues driver over permanent facial scars

Michael J. Marler filed suit last week in St. Clair County against Brian Kessler over a car accident that Marler claims left permanent scars on his face as well as loss of income.

The accident occurred in April 2007 when Kessler sideswiped Marler's vehicle as he was trying to turn left out of his driveway onto Old Freeburg Road.  As a result, Marler struck a tree, sustaining property damage, bruising and injuries to his orthopedic, neurologic, and muscluar systems.

Marler alleges that Kessler was negligent for failing to keep his car under control and to avoid a collision, and by failing to yield right of way. He seeks compensation for lost income, medical expenses, and punitive damages.

  Drunk driver sued in St. Clair County over multi-car accident

Michael Aaron filed a lawsuit last week in St. Clair County in Illinois against Donna Donaby for injuries he incurred after a multi-car accident in which Donaby was liable.

At the time of the crash, Aaron claims he was stopped at a red light in Belleville when Donaby rear-ended a vehicle two cars behind him.  The force of the impact sent both cars forward, and Aaron was hit from behind. 

Subsequent investigation concluded that Donaby's BAC was more than the legal limit of 0.08.

According to the suit, Aaron suffered bodily injuries as well as disability and disfigurement.  He claims his injuries resulted in past and future pain and suffering as well as lost income and medical expenses.

The two-count suit alleges that Donaby was negligent by driving in excess of the speed limit and under the influence of alcohol with a BAC of more than 0.08.  She also negligently drove when she knew she was unfit to do so and failed to avoid a collision.  He currently seeks a judgment in excess of $100,000, plus costs.

  Family gets $1.5 million for fatal Metro bus accident

King County officials settled a wrongful death lawsuit filed by the family of Michael Dahlquist over a 2008 accident involving a Metro bus for $1.5 million.

Dahlquist, age 21, was driving his pick-up truck on Highway 164 when a Metro bus driver apparently swerved to avoid another vehicle and hit Dahlquist's truck.  Police investigation of the fatal crash showed that the bus driver may have been speeding.

Dahlquist's family filed suit against the county claiming that the driver's negligent driving was the reason for their son's death.  The family's attorney filed documents alleging that the driver had a history of accidents, thus claiming that the King County Transit Agency was negligent as it allowed the driver to continue working.

  Drunk driver kills woman and gets his sixth DUI

After five DUIs, many wondered how Joseph Lynchard, 76, still had a drivers license.  They also wonder what he was thinking on the Monday afternoon after Easter in 2005 when he decided to drive home from his brother's bar after drinking more than a liter of red wine.  This decision not only earned him his sixth DUI charge, but it took the life of Kathryn Black who was biking on the side of the road.

At the time of the accident, Black had stopped to rest and was straddling her bike.  Lynchard, who had a BAC of 0.24 percent, slammed his car into her from behind.  She died from catastrophic injuries to her brain, neck, and spine.

In a civil suit, Kathryn's husband Hugh held Joseph directly responsible for his wife's death.  Furthermore, he alleged that Eddie Lynchard and his bar also bore responsibility because he knew that his brother frequently drank in excess at the bar and would drive home afterward.  Despite his record of reckless behavior, he even financed the truck Joseph drove the day he killed Black. 

According to court documents, by agreeing to look after his drunken brother, (after the previous 5 DUIs) Eddie assumed a legal obligation to control him.  Therefore, when Eddie let Joseph drink to the point of intoxication and then drive home, he essentially aided and abetted the behavior that lead directly to Black's death.

Although Eddie's attorney claims that Joseph bears sole responsibility for the accident, he advised his clients to settle.  Maxing out their personal, business, and auto insurance policies, the settlement came to $1.25 million.

  Illinois highway worker injured by debris from auto accident

Craig and Colette Poettker filed suit in a St. Clair County court Feb. 26 seeking more than $700,000 for injuries that Craig sustained by a flying piece of debris while working on a road construction zone in Belleville. 

The debris was the result of an accident where Joseph Courtney crashed through a barricade while trying to change lanes.  The debris went flying and struck Poettker, causing him to suffer severe and permanent head and leg injuries.

Investigation proved that Courtney was driving in excess of 35 miles in the construction zone and failed to slow down to the posted speed limit when workers were present.  Furthermore, he failed to keep a proper lookout for hazards and maintain control of his vehicle, which resulted in him hitting the barricade.

According to the suit, Poettker claims the accident caused, "mental anguish, incurred medical bills, lost income," and the inability to attend to ordinary affairs of life.  His wife also claims a loss of consortium and society.

  Daughter sues Chicago cab company over father's death

Nicole Lynn Roberts filed suit Wednesday against a Chicago cab driver and the Checker Cab Company after the cab driver hit her father while he crossed the street on February 7.

Minh Pham, 89, had the right of way at an intersection when the driver failed to yield and struck him.  He was hospitalized in the critical care unit but died later that evening from his injuries. 

According to the suit, the driver failed, "to keep a proper lookout, to decrease speed while approaching and crossing an intersection, and to yield the right of way to a pedestrian in a crosswalk."  Police also cited the cabbie for a lack of insurance and failure to exercise due care for a pedestrian in the roadway following a crash.

The three count suit seeks more than $50,000 in damages.

  Jury awards $13.7 million in Chicago car accident lawsuit

Chicago plaintiffs finally have closure after losing their son over four years ago in tragic car accident that left three others seriously injured.  This month, a jury awarded the family $13.7 million in damages after concluding that the driver was 98% liable for the victim's death.

In August 2004, the victim was working as a BMW salesman and took the defendant and two of his friends out for a test drive in a BMW 530i sedan.  The defendant was only 20 years old and during the drive, he increased his speed to 90 mph in a 45 mph zone.  The BMW then clipped another vehicle and crashed in a light pole with the brunt of the impact on the passenger side, killing the victim and causing critical injuries in the other passengers.

After recovering from his injuries, the defendant pled guilty to aggravated speeding in 2005, but denied liability for the salesman's death claiming that he was the one who encouraged him to drive faster than the speed limit and never advised him to slow down.  Furthermore, the test drive violated the dealer's policy because they drove the car outside of the established route.

The plaintiffs, however, believed that their son would still be alive if he had used better judgment behind the wheel.

Following a one-week trial, a jury agreed with the plaintiffs and returned a $13.7 million verdict stating that the defendant was 98% responsible for the accident under the Illinois Comparative Negligence statute.

  Railroad Signalman awarded $48 million in FELA suit

After repeated legal motions and appeals, a California judge recently upheld the largest verdict under the Federal Employer's Liability Act in history- $48 million.  The plaintiff, Eric Doi, was a Union Pacific signalman when he was involved in an auto accident in 2007 that resulted in the paralysis of all four of his limbs. 

At the time of the accident, Doi was a passenger in a company-owned truck when a coworker became distracted and lost control of the vehicle, sending it down an embankment and in front of oncoming traffic. 

Throughout the case, Union Pacific attempted every argument denying liability despite the fact that FELA clearly states that a railway is held liable for the negligence of a co-worker.  Last fall, a jury awarded Doi $48 million in damages, but Union Pacific attorneys pushed for further judicial review.  Even despite the most recent judicial upholding, UP's lawyers indicate they still intend to appeal to a higher court.

  Wrongful death suit settled over bus crash fatality

This week, the Huntley Project School District reached a settlement with the parents of a 7-year-old girl who died in a bus crash last year.  Sarah Fark, an elementary school student at Huntley, was riding a school bus when it pulled in front of an oncoming pickup truck. 

Tuesday, the school board of trustees voted to approve the settlement, but did not release details to the press.  According to the school's superintendent, trustees did not know the terms of the settlement until it was time to vote at the executive session on Feb 10.

The bus driver pleaded guilty to careless driving and failure to yield.  She received a six-month suspended jail sentence.

  Intoxicated employee leaves meeting, kills motorcyclist

In simultaneous proceedings, a former Erie Coke Corp. employee faces criminal charges of vehicular homicide as well as a wrongful death suit in an Erie Court after killing a motorcyclist last August. 

At the time of the crash, Martin P. Allen was on his way home from a meeting of Erie Coke employees at the Huzars Club when he hit Kevin R. Imler with his SUV as he was turning left in front of the motorcycle at an intersection.  Police arrested Allen for driving under the influence with a .248 blood alcohol content, which is three times the legal limit in Pennsylvania.  

In the civil suit, Imler's estate filed against Allen, Erie Coke Corp. and the Huzars Club.  According to the state's Dram Shop Act, taverns can be held liable if servers provide alcohol to a visibly intoxicated consumer who causes harm.  Furthermore, since Allen was driving a company-owned Mercury Mountaineer and leaving an employee meeting when the crash occurred, the corporation can liable for Allen's actions. 

Reports also state that Allen had a previous DUI on his record and that Erie Coke employees bought him drinks at the meeting.  The suit claims that considering Allen's previous driving record, the employees present at the meeting should not have let him leave if he was visibly intoxicated.
