| Four Year Old Killed in Four-Car Crash in Illinois |

A four year old boy died after being involved in a four-car crash on the Northwest Side of Chicago Sunday morning. The driver of the car in which the four year old and a two year old were riding rear ended another car in the first auto accident. The first car then crossed over to the next lane due to the impact and struck a third vehicle. The second car then struck a fourth car as a result of the first driver's actions. . The driver of the first car and the two year old were taken to area hospitals but information has not been released regarding any serious injuries. At this time, investigators say the driver of the first car is in police custody and investigators are continuing the investigation.

A man was killed in a motorcycle accident when he crashed into a car on Hampton Avenue at Milentz Avenue in St. Louis on Sunday. He was traveling northbound on Hampton when the driver of a car hit another vehicle while attempting to pass which led to the collision with the motorcycle. | Goal of Camera to Boost Rail Crossing Safety |

While cameras at traffic stops have seen much press, cameras at railroad crossings have had much less attention. In May of 2008, a camera was installed on Rock Hill Road near downtown Webster Groves to catch motorist trying get past railroad warning devices. During the first 1 ½ years, it has resulted in about 1,100 citations to gate running. Last year, of the 1,896 incidents at railroad crossing in the United States, there 247 deaths and 705 injuries according to the Federal Highway Administration. Enforcement through installation of a camera is one way for a municipality to increase safety. According to railroad spokespersons, however, enforcement is just one of the factors to increase safety; the other two factors are engineering and education.
There has a been a slight drop in the number of railroad crossing accidents and part of this is due to the number of crossing that have been closed in the past six years. The Federal Railroad Administration asked railroads to be more aggressive in this area.

| Two Teens Die and 54 Others Injured in Multi-Vehicle Accident on I-44 |

National Transportation Safety Board is investigating the Missouri crash in Interstate 44 that involved twoschool buses, a pickup truck and a tractor trailer. The crash resulted in the deaths of two teenagers and injuries to fifty-four other students. Two girls remain hospitalized; however, their names have not been released. The accident occurred when a semi slowed down for road construction and a pickup truck driven by a 19 year old man of Sullivan crashed into the back of it. Two school buses carrying high school band students then slammed into that wreck. A 15 year old girl of St. James, was killed when she was in the back seat of the first bus. Charges will probably not be filed against any drivers until the final patrol reported is completed which may take up to six weeks.
Investigators are hoping to discover some information that will make school bus travel and road construction zones more safe. Summer is a busy time for road construction and wrecks are common in work zones. The Missouri Department of Transportation is doing work on 250 bridges and improving 5,600 miles of roadway. Accidents continue to happen in spite of their safety education efforts, signage, stricter penalties and fines for construction area violations.

| Two Die On I-70 Near Highland, Illinois |

Two crashes invovling tractor trailers, about two miles a part, claimed two lives on I-70 near Highland, Illinois. In one of the crashes a pickup truck was sandwiched between two tractor-trailers possibly resulting from a slow-down from another crash ahead that took place about 10 minutes before. One of the drivers of the tractor trailers was unable to escape when his tractor trailer caught on fire. A crash had occurred approximately 10 minutes prior on I-70 further westbound involving a tractor trailer cabin and trailer veering off to opposite sides of the highway, dumping boxes of food across the median.
Police report that a third accident occurred with a tractor trailer and a motorcycle. The motorcycle crashed into the back of the tractor trailer, causing injuries to the motorcyclist. Traffic was backed up for hours and Highway Patrol was redirecting St. Louis bound traffic. The identity of the victims has not been released.

| Amtrak Train Involved in Two Accidents in One Day |

Amtrak train traveling from Lee's Summit to St. Louis was involved in two train-auto collisions with pick-up trucks on Thursday. At 8 a.m., a 44 year old man drove around a crossing bar that had just been lowered and was struck. The truck was sheared in half and the man was ejected about 40 feet. The driver was rushed to the hospital with serious injuries and remains in intensive care. It was later determined that the driver was driving a truck that had been stolen earlier from a sanitation business. Then, two hours later, the Amtrak train struck a maintenance worker's pick-up as it was sitting too close to the tracks. The maintenance worker was spraying weeds from the inside of the truck and did not have time to move. The second collision occurred at a section of the track that did not include warning signs. None of the passengers on the Amtrak train were injured in either collision.

While both collisions were avoidable, both could be classified as different type's personal injury claims. According to the Missouri State Highway Patrol, the St. Louis area accounts for 102 of the state's 236 reported bicycle related accidents. St. Louis area is considered to be St. Louis City, St. Louis County and St. Charles. According to many experts the higher number of reported accidents is due to the fact that cycle advocacy groups in the metropolitan area do an excellent job of making cyclist aware that they need to report accidents to ensure documentation. Often, in many rural areas, accidents are not reported according to experts. So why is St. Louis considered a bicycle-friendly city? St. Louis received a bronze star for its efforts to make the city and roadways bicycle friendly. When awarding the star, the League of American Bicyclists consider engineering, education, encouragement, enforcement and evaluation. St. Louis recieved stars in education and enforcement. St. Louis also participates in National Bike to Work Day and hosts the Gateway Cup and Tour de Soulard. Columbia and Springfield also received acknowledgements for their efforts to make roadways bicycle friendly. St. Louis has bike lanes on 30 percent of the city's roads with more on the way. However, there is controversy about possible bike bans in the St. Charles area. There are advocates for and against bicyclist and increasing bicycle lanes. | National Misuse Rate of Child Safety Seats as High as 80% |

Motor vehicle crashes are the number one killer of children ages 1-14. While some crashes simply cannot be survived, over 57% of deaths for children 0-15 occur because the child was not restrained and many more occur due to the child being improperly restrained. Nationally, the misuse rate of child safety seats is over 80% and as high as 95% in some areas. Infant seats have been shown to reduce a child's fatal injury by 71% and toddler seats by 54%.
Due to a child's inexperience and lack of understanding toward many dangers, they are the most susceptible to death or injuries in a motor vehicle. Because of the increases in child fatalities in motor crashes, researchers have studied the causes of child injury during motor crashes and steps to help prevent them.
Harsh Grewal, MD, a pediatric surgeon from Temple University School of Medicine and Hospital in collaboration with his colleagues reviewed 10 years worth of medical literature on children and motor vehicle accidents.
Their study revealed that children involved in car accidents when they were inappropriately seat belted were at a higher risk for "seat belt syndrome", a complex of injuries to the spine and abdomen. Pediatric health care professionals should be wary when receiving children that exhibit bruising as it may indicate much more serious injuries such as spinal cord injury, abdominal and or spine tenderness and neurological deficits. It was found that boys are more susceptible to injury than girls and that eh incidence increases with age.
There are some basic rules for child safety in motor vehicles from the Centers for Disease Control and Prevention:
- Kids 12 and under should always ride in the back seat. This cuts the risk of death by 36%
- Kids should be in a car seat or booster until they can be seated properly in a seatbelt. For most children, this is around 8 years of age or 4'9" tall, but proper seatbelt fit is the most important factor.
- Never place a rear-facing car seat in the front seat when there is an active frontal airbag.
- Keep your baby rear-facing as long as possible. That can mean up to 30, 33 or 35 pounds in most current convertible seats unless they outgrow it by height first.
- All current car seats should pass government safety standards. Select the one that best fits your child, your vehicle and your budget. Some models do have different features; select one that has the features that will allow you to use it correctly on EVERY trip.
- Always read the owner's manuals for your vehicle and car seat thoroughly. They often contain specific information about car seat installation that may not be obvious. Some models may vary from what you would expect.
- Make sure the harness fits snugly on your child, the car seat fits snugly in your vehicle, and that your vehicle seatbelts are locked properly.
- Why you buy a car seat, make sure you have a good return policy in case it doesn't fit or in case you find that you do not like it. Have your seat inspected by a certified technician for free at a checkup event or fitting station.
- Please be wary of used car seats, especially those over 6 years of age, those with an unknown history that may have been in a crash, those that show any form of cracks or damage, and those with missing labels, model numbers, manufacturing date, instructions or parts.
- Please give driving your complete, unimpaired attention and wear your own seatbelt all the time. These two simple steps are among these easiest ways you can protect yourself and your passengers from injury or death.
Obviously some restraint is better than none at all. In a collision, an unrestrained child continues at the speed of the automobile until they come into contact with some part of the interior. | Six Children and One Adult Injured in St. Louis |

At least six children and one adult were injured in two car auto accident in North St. Louis. The driver of a van said she could not see the Mercedes as a bush in the median was obstructing her view. The driver of the van was transported to the hospital as well as the six children who were passengers in the van. The van struck a three-foot brick was that was attached to an apartment building. Two of the children were transported to the hospital urgently with one possibly having critical injuries. The occupants of the Mercedes refused treatment.

| Teen Dies, Another Injured After Truck Overturns |

An 18 year old teen died from injuries she sustained after a one vehicle auto accident. The teen was a passenger in a truck driven by a 19 year old teen, both from Union, Missouri. The 18 year old teen was thrown from the truck after it left the roadway. The driver overcorrected, returned the truck to the road, and went off the road on the other side and overcorrected again, thus the vehicle overturned.
The teen was taken by helicopter to St. John's Mercy Medical Center but died later that afternoon. Police have not indicated if seat belts were being worn at the time of the accident. While seat belts are a great determinant between serious injuries and death in many cases, wearing them does not insure walking away from a crash with just minor injuries. Investigators will need to conclude if seat belts were worn and if not, then could the injuries have been less catastrophic is worn

| Semi Trucks Crash Killing Cattle & Costly Property Damage |

Sixteen of 34 cattle survived a two semi truck accident last night at about 11:50 p.m. One driver was talking to another driver on his CB radio when he crashed into the rear of the box trailer. Upon impact, the truck caught on fire and the driver dove out of the driver's side window that was partially down. The driver was unable to extinguish the fire that caused the trailer tires to explode and blew the bottom out of the aluminum cattle hauler.
The driver of the other truck, a Volvo semi-box trailer was not seriously injured nor was the driver of the cattle semi. However, the cattle truck, a 1999 Peterbilt semi was a total loss as were some of the cattle. The driver of the cattle truck was cited for driving too closely. As well, westbound and eastbound traffic on Interstate 94 were closed for most of the night due to several cows running loose and officials afraid they cattle would jump the three foot median.

| Teen Drowns in Lake St. Louis |

A Florissant teen died in a drowning accident late Sunday night in Lake St. Louis after he jumped off the boat for a last swim and never resurfaced. He and six friends were pontoon boating and were returning to the Woodlands Marina. Officials said the teen's friends lost sight of him and searched for several minutes. According to officials, the group had consumed alcohol and had gone out on the boat around 10:30 p.m. Missouri State Water Patrol, Lake Saint Louis Police officers, EMS personnel and firefighters from Lake Saint Louis, O'Fallon and St Charles all searched for the missing teen. The young man was found in about 10 feet of water and about 50 feet from the shore at approximately 4 a.m.
Officials do not know if the teen was a good swimmer and are investigating to determine if alcohol was a factor. The driver of the boat, a 23 year old man of Wentzville was arrested on suspicion of boating while intoxicated according to Missouri Highway Patrol. Authorities do not at this time, believe the condition of the boat operator had a bearing on the death.
The teen was known for being an accomplished athlete at the local high school in Spanish Lake. At this time, the death has been determined as accidental but officials are still waiting results from the medical examiner.

| Weather & Ignorance Lead to Increased Water Deaths According to State Officials |

On Missouri waterways, there have been 30 drowning deaths thus far in 2010. That number had doubled since last year. Heat and flooding contribute to more deaths. People spend more time around the water when the heat rises and as flooding causes swollen rivers. As well, people trying to drive through water on roads are counted among the drowning deaths.
Some individuals believe that rushing water such as the swollen waters of the James River would make for a better river experience. According to experts, swollen, rain-filled rivers should be avoided due to swift currents and rising water hides objects such as tree limbs that can trap watercraft and swimmers, causing death.
Inability to swim and failure to use lifejackets continue to be a problem according to officials. Even though the opportunity to save a drowning person does not occur that often, everyone needs to remember that person is panicking and will take a rescuer down with him or her. Be sure to keep a barrier such as extending a paddle, throwing a life preserver or rope, or pushing a raft to the drowning person. While often the case, it is especially true with children that there is not a cry for help, but the individual simply slips under the water. Vigilance is crucial when people are in the water.
Another common factor in drowning deaths is alcohol. Not just for boat captains but for passengers and swimmers as well. Alcohol is frequently a factor in boating accidents. Alcohol affects judgment and reflex time as well as fatigue levels. Swimmers must know their own limits and keep alcohol intake within reason.

| One Dead after Head-On Collision in Madison County |

A fifty-three old Collinsville man died after a two-car collision on Bluff Road in southeastern Illinois. The man was driving a Chrysler Sebring and was northbound when he may have drifted into the southbound lane. His car collided with a Toyota Celica that was driven by a 19 year old girl. However, according to investigating officials, they are still trying to determine if it was in fact the man that drifted into the opposite lane. The 19 year old girl was taken to a St. Louis area hospital with serious injuries.

| Woman Dies in Horrific Accident, "Texting" a Possible Contributer |

A 21 year old woman crashed into a semi truck and was ejected from her car when she was then struck by a second tractor trailer on Sunday afternoon. Officials pronounced the woman dead at the scene. A witness reported that they had seen the woman texting just before the crash. She lost control of her 2000 Oldsmobile Intrigue and left the highway, striking a guardrail. She then spun back into the highway and struck a tractor trailer. After crashing into the first tractor trailer, she was thrown from her car and then struck by the second tractor trailer. The crash remains under investigation and due to the damage to the car, it cannot be determined if she was wearing a seatbelt. However, her phone has been recovered for investigation as to time and use to determine if "texting" was a contributing factor in the horrific accident. No reports were made in regard to the injuries the drivers of the tractor trailers may have sustained.

| 10 Die on Missouri Highways Over Weekend |

The Missouri Highway Patrol responded in nine counties to accidents that killed 10 people over the weekend. Car accidents, motorcycle accident,bicycle accident, and a pedestrian hit and run were among the tragic events. Twelve people died over the July 4th weekend and that number included local police agencies in addition to the Missouri Highway Patrol. Therefore, this past weekend was more deadly than the last holiday weekend as there were 10 fatalities that the Missouri Highway Patrol worked alone. This number does not account for any injuries or fatalities reported by any local agencies.
First Crash: Saline County: A 27 year old man was struck and killed while walking along I-70 by a hit and run driver.
Second Crash: Cole County: Two Jefferson City men were killed in a head on car crash. Both men died at the scene. The 36 year old driver crossed the center line and crashed into the 30 year old driver. Both men were pronounced dead at the scene.
Third Crash: Franklin County where a 32 year-old St. Louis man died when the car he was driving veered off the road and overturned.
Fourth Crash: Greene County: An 87 year-old man died when he drove into the path of another car on US Hwy 160
Fifth Crash: Jasper County: A 46 year-old man was riding a bicycle Saturday morning when he was struck from behind by a pick-up. According to police, the driver of the pick-up never saw the bicyclist.
Six Crash: Clay County: A 44 year old-man and his passenger where thrown from their vehicle when it overturned after the driver proceeded to pass illegally. The passenger sustained serious injuries.
Seventh Crash: Macon County: A 31 year old man was thrown from his car after crossing the centerline, running off the road, striking a ditch, mailbox and cable box.
Eighth Crash: Buchanan County: A 25 year old man was killed on his dirt bike when he was hit by a southbound Jeep. He was not wearing a helmet according to patrol while operating his motorcyle.
Ninth Crash: Newton County: A five year old girl died in a two-car crash on US 60, east of Neosho. Eight additional people were injured, four sustained serious injuries. According to patrol, a car ran a stop sign and pulled into the path of the car the five year old was a passenger. Both cars went down an embankment. The child died at the scene and the driver other car is being investigated for blood alcohol.

| Illinois' Plan to Reduce Railroad Related Accidents |

The Illinois Department of Transportation and Illinois Commerce Commission are working together in developing a plan to reduce railroad crossing accidents. The new regulations must be submitted to the Federal Railroad Administration for approval. The key concepts (Chicago Tribune) in the plan include:
- Closing as many crossings as possible to reduce potential conflicts with trains and vehicles. This incentive is generally viewed as unpopular in metro and rural areas due to heave vehicle traffic.
- Installing train-control technology to detect the presence of a trapped vehicle on tracks and provide advance warnings to locomotive engineers and railroad personnel. The estimated of installing such technology is estimated to be $700,000 per crossing
- Building overpasses or tunnels to separate rail and highway traffic. This option is the most expensive, estimated at $20 to $40 million per location
- Eliminating pedestrian crosswalks over tracks at passenger rail stations and installing fencing to deter pedestrians from trespassing onto tracks.

| Bicyclist Killed After Colliding with Moving Train |

Listening to earphones while riding a bicycle across train tracks seems to be the cause of the death of a 32 year-old Utah man according to officials. While the train intersection was in the middle of a downtown area and the train was thought to only be traveling at approximately 25 mph, the bicyclist never seemed to see or hear the train lights or sirens as he crossed the tracks. Even though the train conductor utilized the emergency brakes, the man was still carried almost 100 feet down the tracks after the initial train collision. Trains traveling even at a rate of 25 to 30 miles an hour have a great deal of inertia and cannot stop very quickly. Seemingly, the young man was lost in his thoughts or the music and failed to hear the multiple train whistle blows. Safety experts caution using earphones while operating any type of moving vehicle and say it can be perilous as a pedestrian as well if traveling on busy sidewalks or streets. | Two Injured in South St. Louis Crash |

Two people were seriously injured after the car they were in crashed into a yard in south St. Louis. Police report that the car collided into a truck before crashing into the yard. Emergency personnel had to cut the car to remove the driver after the auto accident. The driver and passenger were taken to a local hospital. Their current status has not been released.

| Lifeguard "On Duty" Does Not Always Equal Safety |

Many people assume a pool or lake area is safe if a lifeguard is "on-duty", however, many drownings occur daily and often times in areas where lifeguards are on duty. Ten people die a day on average from accidental drowning and more than 1 in 5 involve children ages 14 or younger. A visual study done by CBS including the work of a safety consultant observed many lifeguards and found many paying close attention. However, they did observe some lifeguards texting and doing paperwork. In these instances, children would be more safe if a "No Lifeguard On Duty" sign where hung for parent awareness.
A drowning can happen in a few short seconds and there should always be qualified and observant adult supervising swimmers to avoid swimming pool accidents. | Teenager Killed in Boating Accident |

A Jerseyville teenager was killed Saturday on Lake Lou Yeager in a boating accident. According to the Illinois Department of Natural Resources, the girl was killed by contact with the boat's propellers. The driver of the boat was apparently trying to pull out of a cove where several other boats where anchored as well, when the boat came into contact with the teenager. The conservation police are continuing their investigation. Lake Lou Yaeger is a reservoir about 50 miles northeast of St Louis.

| Pedistrian Dies After Being Struck by a Car |

A pedestrian has died after being struck by a car last Thursday. The St. Louis woman was apparently running from a man chasing her on his bike when she was struck by the car. She became stuck in the windshield and the car crashed into a restaurant drive-thru. She originally lost part of her leg and suffered multiple serious injuries which resulted in her death. One of the passengers in the car was covered in broken glass and hospitalized. Police are investigating the identity of the man chasing the pedestrian on the bicycle. The pedestrian-auto accident occurred around 3 a.m. on Wednesday evening. The St. Louis woman died on Thursday.

| Truck Driver Charged with Homicide with by Vehicle |

A truck driver has been charged with homicide by vehicle in a deadly five car crash on Route 209 in Monroe County, Pennsylvania, that has killed one and left several others with catastrophic injuries. Last Thursday evening four vehicles were stopped at a red light facing northbound when the tractor-trailer traveling northbound in the right lane failed to stop and crashed into the back of a Mini Cooper. The Mini Cooper then struck a Chevrolet Corvette and then crossed the intersection and crashed into a guard rail. The Corvette was pushed into the left lane and collided with a Chrysler 300. After striking the Mini Cooper the tractor trailer then continued straight and hit a Hyundai Santa Fe. The Hyundai was shoved into the intersection and the tractor trailer veered off the road and crashed into a traffic control pole and caught fire. The traffic control pole then fell on the Hyundai. The driver of the Hyundai and her passenger were air lifted to an area hospital.
The truck driver was arraigned on charges of homicide by vehicle, following too close, and careless driving.

| 41 Year Old Man Dies After Jet Ski Accident |

A 41 year-old Maryland man was in a Jet Ski- boat collision Saturday evening. He suffered life-threatening injuries in the crash. There were no other victims at the time of the crash. A boater reported the crash and held the injured man alongside his boat until the Coast Guard crew arrived at the scene. The man was flown to Baltimore to the shock trauma center. Maryland Natural Resources Police are investigating the accident.

| Driver Going Wrong-Way Crashes Into Tractor Trailer |

A driver traveling in the wrong direction on I-70 crashed into a tractor trailer this morning near Kansas City. The driver was traveling west on an east bound lane. Missouri Highway Patrol drew blood from the driver to check the driver's blood alcohol level, however, it is unknown at this time if there will be charges. The driver sustained injuries in the collision with the tractor-trailer and I-70 was closed for an hour for auto accident clean up.

| Five Motorcycle Deaths within 48 Hours |

Five people were killed in motorcycle related accidents over last weekend in western New York. Surprising to many people is the fact that the majority of the motorcyclists killed were in their 50's. Safety experts say that this is not all that surprising for a several reasons. Many older motorcyclists got their licenses in the 1970's and can now afford larger, more powerful motorcycles. Also, many older motorcyclist wear novelty helmets called "peanut" helmets that do not provide the protection of standard helmets. Motorcyclists wearing the peanut helmets are frequently seriously injured in accidents from which they should be walking away or sustaining only minor injuries. Other serious complicating factors are the texting, talking on cell phones, and listening to loud music from radios and iPods by motorist which distracts them from paying attention to motorcyclist on the roadways. The beginning of the summer season is an adjustment time as well as motorist are not as accustomed to so many more motorcycles on the roadways or being aware of them.
Motorcyclist can keep themselves safer by wearing appropriate helmets and taking motorcycle safety driving courses so they can be better defensive drivers.
The five fatalities included four men and one woman. Alcohol was a factor in one fatality when a 48 year old woman was ejected off the back of the motorcycle she was on. The driver of the motorcycle sustained serious injuries and was charged with vehicular manslaughter. A 29 year-old man died at a hospital resulting from catastrophic injures he sustained when he was ejected from his motorcycle in a motorcycle-van collision where the force of the impact hurled the motorcycle onto him as he lay on the shoulder.
A 50 year-old man died after he missed a curve and hit a guard rail and sign post and suffered full body trauma. And another 50 year -old man was killed when he was ejected from his motorcycle after he lost control. He was wearing a helmet but sustained serious injuries to his upper body. And early Saturday, a 56 year -old man was killed when he and his passenger were ejected from their motorcycle it left the road. The passenger was flown to a local hospital and is stable.

A six year-old girl was killed when she was hit by a car involved in a Los Angeles Police high-speed chase. Los Angeles Police were chasing a suspect they had witnesses making a drug deal. The suspect lost control of his car in a residential area and struck the little girl and pinned her against a stone wall. The tragic pedestrian accident occurred Thursday evening. The six year-old sustained serious injuries and died at the hospital. Two passengers in the suspect's car were taken into custody; however, the driver fled the scene and has not been apprehended. The officers witnessed the suspect flinging a gun from the car during the chase.

| Motorcyclist Dies After Crash |

A Washington man is dead after he was struck from behind by a Camry as he was stopped on his motorcycle at a red light in St. Peters. The motorcyclist was sitting eastbound on Highway 94 at Kisker Road when an eastbound Toyota Camry struck him just after the light changed to green. The Washington man was thrown from his 2010 Triumph. The motorcyclist suffered catastrophic injures that led to his death. The police have not determined why the Toyota Camry re-ended the motorcyclist.

| Elderly Woman Dies and Two Injured in Two-Car Crash |

A 90-year old St. Louis woman was killed Memorial Day in a two-car crash. She was passenger in a car driven by her granddaughter. Another passenger in the car was also injured. The granddaughter was driving a Honda and attempted to make a turn and did not see the Jeep Grand Cherokee at the intersection of Interstate 70 and Ind 9. The driver of the Cherokee said he was driving northbound on Ind. 9 from New Road when the driver of the Honda hit him. The Cherokee collided with the Honda's passenger side. The St. Louis grandmother was air lifted to a local hospital and later died due to her catastrophic injuries. The other two passengers in the Honda were treated for minor injuries due to the auto accident.

| Three Injured and One Dead in Dent County |

| A Florida man was killed last Thursday night after a violent motorcycle accident. The victim was riding in group of motorcycles when he lost control and hit a light pole. His body was thrown from the motorcycle over an embankment and landed almost 350 feet in a yard below. The motorcycle continued down the highway for another 350-400 feet. It was a particularly gruesome accident as the victim's legs were missing after the impact. | Father and Infant Die from Crash into River Des Peres Water Channel |

Despite heroic efforts by a local St. Louis man, a father and infant died after the father's car veered off River Des Peres Boulevard. Todd Gilliam noticed the accident and rushed to assist the motorist in the sinking car. He had to wait a few minutes after he called for help so that someone could watch his own three year old daughter. Gilliam dove into the water channel and with the assistance of a police officer, they were able to cut the seat belt and free the father from the sinking car. No one was aware there was a seven month old boy in the car as well. The infant drowned Wednesday as a result of the car submerging. The father never regained consciousness after sustaining serious injuries and died yesterday, four days after the accident. The auto accident and drowning is being investigated by St. Louis Police and as of now there is no reason to believe there were mechanical problems with the car. The reason for the auto accident is still unclear as the father was in apparently good health.

A train and a semi-truck collided on May 14, 2010 in Michigan, and investigators are trying to determine if it was caused by driver error or malfunctioning railroad signals. Dog bites account for over 368,000 emergency room visits per year - that is approximately 1,000 per day. More than 4.7 million people are bitten yearly. Dog bites are the fifth most frequent type of emergency room visits for children.
There are 10 good guidelines provided by the CDC. (Health New Digest) to follow in order to decrease your probability of being bitten by an unfamiliar dog and sustaining serious injuries:
- Never approach a dog whether leased or unleashed. Overcome the urge to pet a dog just because it is near.
- Teach children not to run at a strange dog or scream and wave arms wildly around a loose dog
- Ask the owner if a dog is friendly before attempting to pet a leashed dog
- Avoid staring directly into a dog's eyes, they frequently see this as threatening
- Always allow a dog to sniff and see you before petting them. As well, keep the exchange short
- Never leave children alone around a dog even if you think you know the dog
- Dogs are like toys, they should not be climbed on or cuddled if you don't know them and think about it twice if you do know them
- If a dog is approaching you, do not run away as this may trigger their prey instinct. Stand straight up with your arms folded. Turn slightly to the side and do not look the dog in the eye. Even if the dog is barking and jumping, they usually become disinterested in anything that is not moving
- If a dog knocks you down, roll into a ball and try to be still. Cover your head with your arms. Avoid screaming or rolling as some dogs see this as playfulness.
- Never approach a dog that is eating or playing with something or attempt to take the object away from the dog.

Drowning is the second leading cause of serious injury or death for U.S. children. Nine people drown every day in the US and 75% of the drowning occurs between May and September. Many steps can be taken to prevent your child from drowning or sustaining a serious injury. Children don't just drown in swimming pool accidents. Children can drown in bath tubs, drainage ditches, and buckets as well. The most reasonable solution to safeguarding your children is by teaching children to swim. However, parents of even the strongest swimmers should gather strategies on safeguarding their children around water as to avoid injuries such astramautic brain injury or spinal cord injuries.
Some general safety rules include:
- Children should never swim alone, even if they know how to swim. Cramps and fatigue can cause an accomplished swimmer to drown.
- Always check the depth of the water before diving in. Observe "No diving" or "No Swimming" signs
- Swim in areas with a lifeguard, however, pools that are overcrowded can be very dangerous as the chaos can mask the danger.
- If you give your children a flotation device as toy, it should never be a substitute for a PFD (personal flotation device). Floaties and water wings should never replace the parent.
Some theories suggest that flotation devices should never be given to children so that they can become familiar with the properties of water and learn to swim more efficiently.
- Do not allow your children to run as decks and concrete patios are often wet and slippery. Slip and falls for children can easily occur that would often seem small, however, children can fall quickly and the fall can result in a serious brain injury.
- It is advised that NO DIVING should ever happen in an above-ground pool.
- Keep a telephone outside close to the pool area, so you will not be tempted to leave the pool area for even a few seconds to answer the phone.

| First St Louis Auto Crash Fatality in May |

A St. Peters man was killed in an auto accident on Interstate 70 when the Dodge Durango he was driving was struck by the wheel of a tractor trailer. Equipment failure caused the truck to lose two wheels from the rear axle. The wheel struck the front windshield of the victim's Durango. After the collision, the Durango then traveled to the right and struck the side of a Nissan Altima in oncoming traffic on I-70. The driver of the Nissan was transported via ambulance to a hospital with minor injuries, however, the St. Peters man was pronounced dead at the site. While this is the first fatality of May, it is the 44th highway fatality of the year in the St. Louis area.

| The mother of university student in Illinois filed a wrongful death lawsuit against the Chicago White Sox and a Chicago bar over the death of her daughter in a hit-and-run accident, claiming both establishments allowed her to purchase and consume alcohol prior to her death.
The plaintiff's daughter was only 20 years old last year when she attended a White Sox game with a group of friends. She was served alcohol at the game from stadium vendors and later went to defendant's bar that night. After leaving the bar, she was hit by a car while attempting to walk home intoxicated.
In her 18-count suit, the plainitff cites wrongful death, negligence and the Illinois Dram Shop Act. First, the vendors at the game failed to check Lech's identification and allowed a minor to consume alcohol. Second, the bar and its owners were negligent in allowing an intoxicated minor into the bar and for possibly over-serving the patron who fatally struck her daughter with his car.
At the time of her death, the daughter had a BAC level of .23, nearly four times the legal limit to drive. From her injuries, it appeared she had been either kneeling or sitting on the roadway.

The state Highway Patrol said that the child was not in a child car seat or wearing a normal seat belt when the car he was riding in stalled on the highway. An SUV, unable to avoid the collision, slammed into the car, fatally injuring the toddler, who died two days later from head trauma.
According to reports, the driver of the car, and mother of the child, had been ticketed twice for failing to restrain a child in a car seat.

| The family of a bicyclist who was killed in a collision with a truck filed a wrongful death suit for $5 million against both the trucker and his employer.

| Three-car crash injures five in Chicago |

| A three-car crash involving two taxi cabs and a car in Chicago injured five people, three were reported to be in serious condition after the accident.
According to reports, one of the taxis was t-boned by the car, causing it to strike a pole. The car then collided with the other taxi. When the emergency officials arrived, all the victims were down on the street, but police continued scanning the area to determine if any pedestrians were among the injured.
In all, three victims were reported as serious-to-critical and taken to local hospitals, and the other two sustained only minor injuries.

| Arizona Truck Accident lawsuit settles for $600,000 |

| In Arizona, the parents of a college student killed by a semi-truck and the trucking company who employed the truck driver reached a $600,000 settlement earlier this month.

| A Texas family filed a wrongful death suit earlier this month over a fatal truck accident on a Dallas tollway, naming the truck driver and a Texas toll company as defendants.
In the suit, the family alleges that the trucker was following too closely to another vehicle when he lost control of his truck and hit a median, causing a large piece of concrete to crash through the windshield of the victim's car in the opposite lane, killing him instantly.

| Lawsuit filed against KU Fraternity after student dies from alcohol poisoning |

| The parents of a Kansas University student who died inside his fraternity house in 2008 filed a lawsuit against the fraternity and ten of its members earlier this month, alleging that the fraternity and its members did nothing to prevent underage drinking, and actually challenged the boy, who was a pledge at the time, to drink large quantities of alcohol. Furthermore, despite signs of, "obvious intoxication and a massive head injury," the defendants failed to seek medical help for the teen.
According to reports, the teen was found unresponsive in his bed at the fraternity house. Autopsy showed the victim had a BAC concentration of .362 percent at the time of his death, leading the coroner to conclude he died from alcohol poisoning.
In the four-count suit, the plaintiffs seek damages in excess of $75,000, a potion of which the family says they will donate to the university to educate student about hazing and alcohol consumption.

| A school bus filled with an entire high school basketball team in Minnesota collided head-on with a car on an icy road last week, killing a 27-year-old mother and critically injured her husband.
Although the roads could have been the cause of the accident, authorities claim they are still looking into what caused the crash.

| CPSC enforces new rules for baby product manufacturers after recalls |

In a unanimous vote, the CPSC decided to require all manufacturers to keep track of product owners by providing consumers with postage-paid registration forms. The goal is to alert consumers about recalls faster, especially recalls which could be life threatening to infants and toddlers.

| Car crash kills one teen, injures four |

| A tragic car accident took the life of a teen driver, and injured four of his passengers last week when the teen bottomed out his Acura on a rural road, causing the car to spin out of control.
According to early reports, witnesses claimed the car was speeding extremely fast when they heard the car bottom out in a dip before twisting off the road, ejecting some of the five teens inside. Police estimate his speed to have been 85 mph, with a posted limit of 35 mph.

| A Madison County, IL woman filed suit earlier this month after she and her daughter sustained serious injuries in an accident involving a tractor-trailer.
The accident occurred on I-270 when the plaintiff had stopped due to traffic. Failing to stop his truck in time, the defendant struck the vehicle directly behind the plaintiff with enough force to push the plaintiff's car forward into another truck.

| Maryland Police charged a UPS driver last week after the driver ran a red light and collided with another vehicle, killing the driver.

| Drunk driver kills four |

| A San Antonio man died last week in a car accident after he attempted to pass another car on the right, injuring both his passenger and the driver of the other car.
After the man's SUV went off the road, he lost control and swerved into the path of the pickup he was attempting to pass. The two cars collided, and the SUV continued across the highway and hit a ditch, causing the SUV to flip several times.

| Lawsuit filed after 3-year-old drowns in water park |

| A water park in Ohio was sued last week for wrongful death over a tragic drowning of a 3-year-old boy in a park kiddie pool that occurred this past August.
The complaint alleges that the park failed to have enough life guards on duty the day of the accident, which was a violation the state had previously disciplined the company for in the past. According to the reports from police, emergency personnel and the park, the mother lost sight of the boy from her chair next to the pool and went to look for him. Unfortunately, lifeguards had already found the boy drowned in the water.
The plaintiffs in the suit firmly believe that more lifeguards would have prevented the accident, especially when considering that there were only 67 lifeguards responsible for the 250,000 square foot area, with only 5 watching the outdoor areas. | Illinois Judge affirms $8.2 million Wrongful Death Award |

| An Illinois federal judge affirmed an $8.2 million verdict in a wrongful death claim against the United States and a hospital in St. Louis over the failure to diagnose an abscess behind the plaintiff's abdomen.
The suit names the United States because the St. Louis hospital operation a program in conjunction with a Southern Illinois air force base. The plaintiff's allege that doctors at the hospital failed to diagnose and treat the abscess in time to save the victim's life.
The jury in the original trial found in favor of the plaintiffs, awarding them $8.2 million, which included compensation for medical bills, funeral expenses, lost wages, pain and suffering, and $7 million for loss of consortium.
Both defendants appealed, and the 7th Circuit Court upheld the finding of liability but vacated the award for loss of consortium, sending the case back to the federal court with suggestions on how to calculate damages. However, due to the family's dependence on the victim and the uniqueness of the case, the Judge said the amount decided on by the jury was not inappropriate, and he affirmed the amount of the award.

| Hit-and-Run truck driver still on the loose |

| Texas Police are still looking for the driver of an 18-wheel gravel truck that failed to stop after an accident last month that killed a 5-year-old girl.
According to newspaper articles, while on the way to school, the little girl was asleep in the back of her mother's Camaro with her brother. Suddenly, the truck collided with another vehicle in the oncoming lane, causing it to spin into the driver side of the Camaro and strike the vehicle precisely where the young girl rested her head.
The victim's mother said she saw the truck drive away as she attempted to help her daughter, but among the chaos of the wreck, did not get a good enough look to identify it.
Police investigators believe the gravel truck had attempted to swing out in front of the Mercedes from an outside lane, and the rear of the truck clipped the front of the Mercedes, which then caused it to hit the Camaro. As a result of the impact, the victim suffered a skull fracture and died at the hospital with her parents by her side.

| Excessive speed kills two teens in tragic one-car accident |

| After conducting an investigation, authorities indicated that excessive speed was the cause behind a one-car accident that killed two teenagers, ages 15 and 17, last week in New York, devastating the youths' family and friends just two weeks before the start of the holiday season.
The Police made it clear that neither alcohol nor drugs were a factor, but it was clear that the male driver was driving too fast for the winding, rural road and lost control, skidding into a water-filled ditch and overturning into a tree. | Illinois tractor trailer accident kills one and injures another |

| An accident in Illinois involving a tractor trailer and a pickup truck took the life of a young teen who was riding in the truck and sent the young driver to the hospital.

| Pedestrian injured after falling 15 feet through metal grate |

| A pedestrian in Maryland was rescued by city firefighers earlier this month after falling through a metal grate on the street, sustaining minor injuries.
Police investigation has not revealed the cause behind the grate collapse at of yet, but initial reports indicate that the pedestrian was walking on a downtown side walk when a grate gave way, causing him to plummet 15 feet below the street. He was trapped there for 30 minutes, and after the rescue, EMS transported him to a local Shock Trauma Center for medical care.
According to reports, the grate was more than 30 years old and its maintenance was the responsibility of the building owner at that address. Because of the permit contracts, however, Baltimore City is not liable for personal injury resulting from street grates.

| Multiple-car accident sends several to the hospital |

| A man was sent to an Ohio hospital after running a red light and causing a multiple-car crash last week.
According to Police, the driver was attempting to pass on the right while three cars were stopped for a red light at an intersection. After passing, the driver veered left and struck a Honda Civic that was turning left. This caused the driver's Mercedes to crash into two other vehicles both traveling in the opposite direction. With the initial impact, the Honda Civic ended up crossing four lanes of traffic before hitting a parked car and an office building.
All drivers were transported to a local hospital, but the driver responsible for the accident was helicoptered to Ohio State Medical Center. He was listed in fair condition.

| Mother charged with DWI and manslaughter after crashing vehicle with 8 children in car |

| A 31-year-old woman from New York was charged last week for driving while intoxicated, manslaughter, vehicular manslaughter, and assault after crashing her car with eight children inside. The crash killed an 11-year-old girl.
The tragic evening started with the defendant drinking cognac at a birthday party before loading up the children, including her own two children, in her station wagon for a sleepover. The father of her son, who was only 14 months, tried to stop her from driving and ended up pulling the boy from the vehicle.
When the defendant lost control of her vehicle, she was driving nearly 20 miles per hour over the speed limit. Five of the children were not wearing seat belts, and three of the children were in the back of the station wagon where there weren't any seats.
The young girl who died was one of the three girls in the back, who were all ejected onto the shoulder of the highway when the car crashed. One other girl remains in the hospital with serious injuries.
The victim's father said the maximum punishment for the defendant's crimes is not enough, and he blames the other parents at the party for allowing her to drive.
Although the driver is not expected to be arraigned until mid-November, she will likely face civil actions from the parents of the girl killed in the accident, and the other children who were injured. | Chicago hospital sued over patient death for failure to diagnose |

| A Chicago hospital faces a wrongful death suit, filed last month in an Illinois Circuit Court, which claims that the hospital doctors and staff failed to diagnose bacterial meningitis.
According to the suit, the plaintiff went to the hospital seeking medical treatment for symptoms of headaches and vomiting. Doctors and nurses gave him pain and blood pressure medication, and discharged him. Found in his home unresponsive, he was transported back to the hospital on July 1, 2008, within a week of his original visit, where a CT scan showed brain swelling from meningitis.

| $1.4 Million verdict in Mesothelioma for widow of pipefitter |

| The widow of former pipefitter who passed away from Mesothelioma was awarded $1.4 million by a Tennessee jury in September.
The plaintiff's suit claimed that the defendant sold defective products to the company where her husband worked, which contributed to his diagnosis of Mesothelioma. The plaintitff's husband worked as a pipefitter from 1952 to 1986, and during that time, he was exposed to asbestos contaminated products used by company employees.
The jury deliberated for 2 days before returning a unanimous verdict in favor of the plaintiff, which her attorney stated was a victory for all Tennessee workers who were exposed to asbestos in the workplace by manufacturers who knowingly exposed them to the poisonous products.

| New York woman sues supermarket for spine injury |

| A plaintiff from Long Island, NY has filed suit against a supermarket for permanent injuries she sustained after jars of spaghetti sauce fell off the shelves onto her head, causing neck and spine damage.
In her suit, the plaintiff alleges the supermarket was negligent when employees stacked the heavy jars high on the shelves, making them more likely to fall and cause injury to customers. At the time of the accident, the plaintiff was reaching for one of the jars when several of them collapsed, hitting her in the head. She was immediately transported to a local hospital.
As a result of the accident, the plaintiff claims she has permanent damage, and still experiences pain in her neck. Medical reports showed the jars caused her to suffer bulging discs in her back and damage to her nerves.

| Two injured in 3-car crash in Montana |

| A three car crash near Great Falls, Montana sent two people to the hospital and slowed traffic for more than an hour last week.
Involved in the accident was a dump truck, a green SUV, and a gray car. According to witnesses, the dump truck had stopped to turn left off the highway and turned on his blinker. The SUV also stopped behind him, but the gray car never braked, hitting the SUV at 65 to 70 miles per hour.
Some residents said that particular stretch of road is known for accidents since there is no turnout lane. A highway trooper, however, stated that the driver of the gray car should have been paying attention, and that the highway was not to blame, especially since the dump truck driver used his blinker.

| Wal-Mart employee claims store fired him after filing Workers' Compensation claim |

| An Illinois plaintiff has filed a lawsuit in St. Clair County against his former employer, Wal-Mart, alleging he was terminated in retaliation for filing a Workers' Compensation claim for an injury he sustained on the job in December 2008.
Ten days after being injured, plaintiff's doctor treated his injury and gave orders for him to take off work.
In April, plaintiff notified Wal-Mart that he had contacted an attorney to assist him with a Worker's Compensation claim. A month later, he forwarded off-work slips from his doctor on May 14 and May 28 showing he was still unable to return to work.
Two weeks later, Wal-Mart fired plaintiff, which he claims was in retaliation for filing the Worker's Comp claim. In the suit, he alleged that Wal-Mart knowingly fired him as punishment for his complaint and in attempt to deter other employees from filing such claims.
As a result of his termination, plaintiff claimed a loss of wages, reputation and future employability. He is seeking a judgment in excess of $100,000, plus costs.

| Washington driver faces suit after killing cyclist |

| In February, a university scientist and avid cyclist was killed in an auto accident as he was riding his bike to work. The driver struck the man with her Ford van while attempting to make a U-turn, putting her directly into the man's path.
Last week, after the Police concluded the investigation of the accident, the man's family filed a civil action suit against the Ford driver. The complaint seeks damages on behalf of his wife and two daughters, ages 10 and 13.

| Chicago family receives $15 million settlement for wrongful death |

| The family of a Chicago restaurant executive who died in a tragic plane crash in January 2006 settled for $15 million last week.
The aircraft's pilot was an employee for Morgan Stanley as a senior financial advisor. Accident reports showed that he stalled outside of Chicago after being cleared for landing, and took a nosedive. Four people were killed in the accident.
The lawsuit against the pilot's estate and Morgan Stanley alleged that the financial corporation was had a deficient policy of allowing amateur pilots to fly company clients around on business. Morgan Stanley has since changed its policy mandating professional pilots for all business flights.

| Tractor-trailer accident kills mother and two daughters |

| A fiery head-on collision with a tractor-trailer this past Tuesday took the lives of a woman and her two daughters, ages 4 years and 12 weeks.
Witnesses who saw the tragic accident reported seeing the woman's car cross the center line of a two lane highway, right into the path of an oncoming tractor-trailer. The car then burst into flames, sending bystanders running for fire extinguishers.
Once the flames were put out, a witness who stopped to help told reporters he cracked the back window to let the smoke out of the vehicle. That was when he and the police saw the two girls in the back seat.
The witness's wife, a registered nurse, began giving the baby chest compressions, but unfortunately the infant and girl sustained fatal injuries and were pronounced dead at the hospital.
Police are still investigating the accident, and no charges have been filed.

| Woman killed while working at roadside hot dog stand |

| Last week, a freak roadside accident in Tampa took the life of a woman working at a hot dog stand with her business partner, who was also injured in the accident. According to a Tampa newspaper, the woman wanted nothing but to run her own restaurant, which was why she moved to the city with her family to start a new life.
On Monday, the woman and her friend's husband were set to open a hot dog stand on a busy Tampa avenue. That afternoon, the woman was securing a sign when her business partner heard her scream. Seconds later, he was pinned under the metal tongue of a runaway trailer that had detached from a pickup truck and careened toward their stand.
The man was transported to a local hospital immediately. Police reports indicate that a riding lawn mower tumbled off the trailer, striking striking the woman as she attempted to run away.
The 16-year old truck driver was cited for failing to secure his trailer, which could make him liable for damages from the accident. | Jury awards family $4.4 million for fatal accident |

| A Salt Lake City family received a $4.4 million award verdict over an accident that took the life of their father in 2006 when he attempted to swerve around stopped traffic, running into other vehicles.
At the time of the accident, the interstate was under construction and traffic had slowed to a stop. As the the man approached the crest of a hill, the car in front of him saw the traffic and slammed on his brakes. He then tried to swerve and crashed, dying from his injuries two weeks later.
According to the family's suit, the state Department of Transportation and the subcontractor working on the bridge reconstruction failed to post adequate warnings about traffic delays. The family's attorney stated that he may have known about the construction, but he did not know where the traffic was backing up.
After hearing the facts in the case, the jury returned a unanimous verdict in favor of the plaintiff, apportioning partial blame to both the state and the subcontractor, totaling almost $4.4 million in damages. The jury did find that the man was twenty percent liable for the accident, but the suit prompted the state to reevaluate its traffic safety regulations.

| Colorado Nursing Home faces wrongful death suit |

| The family of a Colorado woman has filed a wrongful death suit against a state nursing home in Trinidad, Colorado.
The family alleges that the staff's negligent care resulted in the woman's death, who suffered from dehydration, malnutrition and complications due to a pressure ulcer before dying in October 2007.
According to the plaintiff's complaint, her ailments were a direct result of the care she received at the nursing home, which was more concerned about the $5,000 allotment per resident from the state than patient health. Furthermore, her mistreatment and death were the result of "knowing and/or intentional actions" by the nursing staff and administrators.

| Truck Driver sentenced for fatal accident |

| As reported in a Maine Newspaper, a truck driver was found guilty for leaving the scene of an accident last year after losing his load of wood beams from his trailer, killing a motorist.
While driving on a winding section of road in January 2008, the trucker lost the beams which then struck a man's vehicle. The trucker claims he did not realize he was involved in an accident until he returned to the scene looking for his wood. He saw the emergency vehicles, but said firefighters blocked him from accessing the road.
When asked if his load could have caused the accident, he told officers no. The Assistant District Attorney stated that by not cooperating with the investigation, the trucker failed to "right his wrong."
Although the trucker admitted his mistake in not owning up to his role in the accident initially, he insists he never intended to leave the scene.

| Couple receives $1.85 million after baby's death |

| A jury out of Maryland awarded a couple $1.85 million last month for the wrongful death of their baby boy, who died only two days after a difficult birth.
On July 5, 2005, the couple planned to welcome their first child, a son, but met with a tragedy instead. While in delivery, the plainitff experienced complications and her doctor advised the couple to choose vacuum extraction.
Two days later, the babe died of complications arising from bleeding between his skull and scalp.
The couple allege that their doctor was negligent when he failed to explain the risks of using a vacuum in delivery. They claim that if they had been properly informed of the risks of the procedure, they would have waited for an emergency C-section.
Although the judgment was substantial, the plaintiffs' attorney said that it would send a message to health care providers that they cannot breach standards of care and fail to involved patients in critical decisions without dealing with the consequences.

| University of Maryland Medical Center faces malpractice suit |

| The family of a man killed in a botched lung transplant surgery last year has filed a wrongful death suit against the University of Maryland Medical Center and a subcontractor involved in the surgery.
In the suit, the family alleges that a contracted staffer incorrectly removed a clamp at the end of the surgery which caused fatal blood loss. So far, the staffer's name has not been released as it is still unclear who was at fault for the blood loss since two perfusionists were working during the surgery and the third person relieved them.
Initially, doctors told the man's family that he died of natural causes during the procedure. It wasn't until all the facts were revealed that his family learned his death was entirely preventable.

| Mail carrier responsible for hit and run |

| Three weeks ago, a mail carrier in California was involved in a hit and run accident in which he pulled in front of a car driven by a 17-year-old boy.
At the time, the mail carrier was attempting to make a left turn, but made the turn too early pulling out directly in front of a car. The boy driving the car swerved to avoid the collision, running into a ditch and colliding with a tree and a parked truck.
Although none of the boy's injuries were life-threatening, he did sustain a number of cuts and deep bruises as well as lacerations from his seat belt.
The mail carrier did not stop after causing the accident to help the boy out of the car. Instead, he offered police two different stories about the incident. First, he claimed he didn't realize he caused a crash until a bystander stopped him. Second, he said saw the boy drive into the ditch, but did not see him hit the tree or car so he drove away thinking the other driver was alright.
According to police, however, regardless of which story is true, the mail carrier can be charged with a hit and run for leaving the scene of an accident. Since he drove negligently, he is also responsible for the boy's injuries and medical expenses.

| Construction worker knocks over utility pole, kills coworker |

| An Iowa construction worker was killed last week in a tragic accident when another employee backed into a utility pole, knocking it over and crushing him.
At the time of the accident, the employee was operating a bobcat skid-loader at a residential site when he bumped a utility pole on the sidewalk. The collision caused the pole to fall over onto a parked truck and fatally struck the victim, age 32.
Accident investigators believe the victim had been reaching into the truck to grab something when the pole fell. It remains unknown, however, why the pole fell so easily when the bobcat hit it.

| A railroad employee filed suit earlier this month against his employee in St. Clair County Circuit Court, alleging that he contracted a musculoskeletal disease from working with unsafe equipment.
Having worked as a carman for the rail company since 1971, the plaintiff claims he was subjected to risk factors that contributed to the development of cumulative trauma or musculoskeletal disorders in his back and spine.
Within the suit, the plaintiff names 24 negligent acts performed by the company throughout his employment, including failure to provide a safe work environment. Most of his health problems stemmed from forceful, repetitive movements which caused him to suffer permanent and disabling injuries to his back and spine.

| Three Columbia residents seriously injured in car accident |

| A three-car accident in Missouri early Tuesday morning on Interstate 70 sent three Columbia residents to University Hospital in serious condition.
According to Missouri State Highway Patrol, a 19-year-old woman was driving the wrong way on Eastbound I-70 and struck another vehicle head-on. Initial reports indicate she was under the influence on alcohol.
The teen driver was arrested on suspicion of driving while intoxicated, driving on the wrong side of the highway and five felony counts of vehicular assault for each of the five people involved in the accident.

| Water district faces wrongful death suit for man's death |

| A Roxana man's estate filed suit in Madison County Circuit Court this month against a public water district after the man died from suffocation while working on a valve in an underground vault.
The man, an employee of the water district, entered the vault to shut off water meters on August 4, 2008. The low oxygen levels and lack of ventilation, however, made conditions inside the confined space dangerous and ultimately caused him to suffocate.
Now, his estate is suing the water district alleging the company, "failed to make a reasonable inspection of the vault and its equipment, to ventilate the vault, to warn users that the vault have a low level of oxygen, to provide a confined space entry program as prescribed by law and failed to provide a safe place to work."
The suit asks for at least $50,000 in damages for each of the three counts.

| Four Illinois residents filed a 12-count lawsuit in Madison County this month over a drunk driving accident that sent them all to the hospital with upper body injuries.
The plaintiffs' were riding in a car when the defendant failed to yield at an intersection and struck the vehicle.

| Drunk driver strikes construction worker outside Chicago |

| According to Illinois State Police, a drunk driver struck a construction worker last weekend, pinning him between two cars, while the man was on a road construction site in south suburban Dolton, IL.
The driver and worker's names were not released, but police reports indicated the accident happened around 4:15 a.m. when the driver of a Cadillac entered a protected work zone and struck the man.
The worker sustained two broken legs after being pinned against the Cadillac and a van. Both men were transported to local hospitals.
As of yet, no charges have been filed against the drunk driver, but he could be held liable for his negligent driving in a civil suit. The construction worker could file a claim to receive compensation for his medical bills and loss wages while recovering from his injuries.

| Fatal accident at construction site kills one, injures two |

| While working on scaffolding, three employees of a masonry corporation in Ohio were involved in a tragic accident that took the life of a 52-year old man.
According to Columbus Police reports, one man fell to his death while working on-site. The two other employees sustained non-life threatening injuries and have been released form the hospital.

| Millions of baby products recalled after reported safety violations |

| According to an article published in Ohio, two unrelated recalls have initiated the return of more than four million baby products across the country after reports of suffocation and drowning deemed the products unsafe.
The first major recall concerned floating pool toys made for infants from Aqua-Leisure Industries. The toys have been recalled after parents filed complaints due to tearing in the leg straps and seats. Tragically, some cases involved a child who fell straight through into the pool and drowned.
The Aqua-Leisure floating toys were sold between December 2002 and June 2009 at major stores like Target, Toys R' Us, Wal-Mart, Dollar General, Walgreens, Kmart and others.
On top of the pool toy recall, over 400,000 baby cribs have also been recalled by Simplicity Incorporated after an 8-month old baby in Houston died from suffocation. According to more than 25 product complaints, the drop-down side of the crib was defective and often became detached.
Both companies have advised all customers who purchased these products to stop use immediately and return them to the original store of purchase for a full refund.

| Voluntary recall for defective electronic timers after Illinois consumers report shocks |

| Intermatic, Inc. issued a voluntary recall of more than 240,000 in-wall electronic timers this week after consumer reports indicated the defective timers risked shock injuries.
According to consumer feedback, the batteries used for the product posed a shock hazard due to the metal within the timer coming into contact with other internal metal parts. The timer is often used on lamps and appliances in leu of a standard wall switch.
As a result of these reports, Intermatic issued an immediate recall of all Intermatic Models ST01 and EI600 timers to avoid further injury liability.
So far, the Illinois-based manufacturer has received at least 12 shocks complaints for this product. These consumers may be entitled to compensation for their injuries.

| Drunk driver kills passenger in one-car accident |

| The morning after the July 4th holiday, Syracuse Police responded to an accident involving a single vehicle that crashed into a bridge abutment.
According to initial reports, the driver of the vehicle had a blood alcohol level of .23 percent, nearly four times the state's legal limit. The driver admitted to officers at the scene that she had, "tons of alcohol," and was driving too fast when she lost control.
Her passenger was pronounced dead at the scene, and driver was taken to University Hospital for her injuries.
Due to the nature of the crash and her BAC level, the driver has been charged with a DWI and second-degree manslaughter for the death of her passenger. The passenger's family could file a wrongful death lawsuit against the driver for her negligent and reckless driving.

| Mylan Laboratories faces a wrongful death lawsuit this month for a man who died of an overdose from a fentanyl patch.
The wrongful death suit was filed by the man's family, who alleged that the Mylan's generic version of the pain relieving patch contained a lethal dose of the drug and not the FDA approved controlled dose.
Fentanyl patches are designed to deliver a constant, controlled dose of the opiate through the skin. Unfortunately, many problems have been associated with patch products, including more than 120 deaths. As a result, the FDA released warnings in 2005 to doctors and patients, warning them about the risks of the painkiller.
For Johnson & Johnson, the current suit is only one of at least 60 fentanyl patch claims against the company in the last year, all of which were won by the plaintiffs.

| D.C. Metro faces $25 million wrongful death suit |

| The mother of a Metro crash victim in Washington D.C. filed a lawsuit last week for $25 million, alleging that the transit agency and its co-defendant bore responsibility for her daughter's death.
The victim was only 29 years old and a mother of two when she was killed in the June 25th Metro Red Line crash that took the lives of the driver and eight passengers. The wrongful death suit claims, "negligent operation of the rail system, failure to discontinue usage of the old and unsafe rail cars, negligent maintenance and inspection of the braking systems, and a dysfunctional train traffic control system."
Some speculation surrounding the accident has authorities investigating whether the train operator was using her cell phone when she failed to stop behind another train. But, Metro officials claim her cell phone was stowed in a backpack and all signs indicate she tried to stop the train for several hundred feet.

| Chevron faces Benzene wrongful death suit |

| A family in Texas filed a lawsuit against Chevron this month over the death of a former Texaco worker who died of multiple myeloma, which doctors attributed to exposure to Benzene while working at the plant.
The complaint, filed June 19, alleges that Chevron knew benzene was a carcinogen that could cause health problems, but failed to warn workers of the danger and take necessary safety precautions regarding chemical exposure.
According to the plaintiffs' attorney, multiple myeloma is an incurable disease that attacks the plasma cells, often making symptoms, "painful and terrible."
Benzene is an industrial chemical often used as a solvent in the production of drugs, synthetics and dyes, and as a gasoline additive.

| Truck driver reports she "dozed off" before causing crash that killed family of four |

| A deadly accident between an 18-wheeler and a van killed a family of four last week in Mississippi. The driver of the truck told police that she "dozed off" before plowing into the back of the van at a red light.
After rear-ending the van, the truck drove over the vehicle, causing it to roll and eject one of the passengers. The van then hit another vehicle before coming to rest on its side. All four passengers were declared dead at the scene, including two young children, ages 12 and 14.
Federal regulations restrict drivers to 11 hours of travel for every 14-hour period before having to rest. So far, driving records for the trucker are not available, so it is unclear how long she was on the road. But, she could face a grand jury for negligence and vehicular homicide. Likewise, the relatives of the family killed could file a civil suit against the trucker and her employer for wrongful death.

| Missouri truck driver fails to stop in traffic, kills 10 people in Oklahoma |

| A Missouri truck driver had a clean driving record up to last week, which was one of the reasons the State of Missouri renewed his commercial driver's license this past April. Now, authorities in Oklahoma are trying to figure out why the driver did not stop, nor hit the brakes, last Friday when he slammed his big rig into a line of vehicles slowed on a turnpike. The accident killed ten people.
Because of the accident, the trucker could face ten separate misdemeanor homicide charges that each carry a 1-year sentence.
Although alcohol was not reported as a factor, investigators have not found a reason why the trucker failed to stop. Furthermore, an initial report concluded that he was traveling at an unsafe speed for the traffic conditions. Therefore, it is likely he will face criminal charges as well as civil action on behalf of the victim's families.

| Three workers die in toxic waste plant accident in New York |

| An accident at a Queens, NY at a toxic waste plant took the lives of three workers last week in what authorities are attributing to inhalation of toxic fumes.
The hole the workers were working on was 18 feet deep and contained about four feet of dangerous, toxic liquid. At the time of the incident, the men were working as subcontractors responsible for vacuuming out a dry well that collects runoff water and construction materials. When one of the workers fell into the hole, another attempted to rescue him with a rope and ladder. The third victim also fell in while trying to help the first two workers.
Reports indicate that the air inside the hole contained dangerous fumes from decomposing waste, which was most like what caused the men to fall and become incapacitated.
The company that runs the toxic waste plant and has been fined by the Occupational Safety and Health Administration in the past and cited for several safety violations, including floor and wall opening, respiratory protection and more.

| Toddler and two others killed in two-car crash |

| Last Saturday, a two-car accident in Phoenix took the lives of a 3-year-old boy and two others.
According to the Phoenix Police, witnesses saw the driver responsible for the accident speeding down the road when he struck a white Murano. The toddler and another passenger in the Murano were ejected from the SUV and died at the scene. The Murano's driver was taken to the hospital in serious condition.
The passenger in the speeding car, a 19-year-old, also died. The driver, however, sustained only non-life-threatening injuries.
Although the crash remains under investigation, police believe that drugs and alcohol may have been a factor. | City faces wrongful death suit for woman's accidental electrocution |

| The city of Columbiana, OH faces a wrongful death suit along with two of its electrical workers over the accidental electrocution of a woman after she stepped into a puddle with an open wire on the street.
The victim was only 39 years old when she set out to deliver newspapers one stormy morning in May 2004. City workers had begun repairing a live wire on the street earlier that day, but left it hanging attached to a block and pulley system used to suspend the wire well above the ground.
They did this to prevent it from being a harm to others, but with heavy rains, a puddle formed around the live connection. When the woman stepped into the puddle, she was instantly electrocuted, and died as a result of her injuries. The two workers who were working on the wire found her lying in the water.
Now, her family has filed suit against the city of Columbiana and the two workers in 2005, and it was re-filed in 2007. A jury will decide whether or not the city was liable for the hazardous street conditions and alleged negligent actions of the two electrical workers.
The plaintiffs' attorney stated that the city workers made poor choices when they decided not to finish the job and suspend a live wire in the air during stormy weather. Furthermore, they failed to place warning barricades around the site and to cut the electricity to that wire. So, what happened to Smith was not so much an accident, but a tragedy caused by a series of poor choices.
