  Work Zone Safety Examined After Recent Interstate Crashes

Recent automobile, tractor trailer and motorcycle accidents have brought highway work zones to the forefront of attention regarding safety.  According to safety engineer for the Missouri Department of Transportation, it takes a split second for disaster to occur while in or approaching a highway work zone.  Three recent crashes in work zones have made experts examine safety practices in road work zones.  Last Thursday evening a prisoner in a Wyandotte county sheriff's car was killed when the car was rear-ended as it slowed for construction on I-70.  This accident occurred just a week after a two teen fatality crash on I-44 that involved two school buses and serious injured several other teens.  On Sunday evening four people were seriously injured on I-35 when their car was hit from behind while it was stopped for work-zone congestion.  Some facts have been released about recent Missouri crash causes in work zones:

                Driver inattention is a major problem.

                Majority of accidents occur in the regular flow of traffic, not during rush hour

                Majority of crashes occur when it is drive.

    Texting, fidgeting with one's IPod,  or letting one's mind wonder can cause a second distraction that could be fatal.  The National Transportation Safety Board is examining work zone compliance and speed limits.  However, if drivers don't pay attention then all of the bells and whistles will not be useful.   Accidents in work zones are up in the state of Missouri and experts attribute some of that increase due to the amount of roadwork that is going on in Missouri.   Missouri has made some changes in roadwork safety to include higher fines for hitting a work zone crew member,  workers wearing fluorescent green vests to enhance visibility, and rumble strips on the highway to warn motorists of approaching highway work zones.   Two Teens Die and 54 Others Injured in Multi-Vehicle Accident on I-44

National Transportation Safety Board is investigating the Missouri crash in Interstate 44 that involved twoschool buses, a pickup truck and a tractor trailer.  The crash resulted in the deaths of two teenagers and injuries to fifty-four other students.  Two girls remain hospitalized; however, their names have not been released. The accident occurred when a semi slowed down for road construction and a pickup truck driven by a 19 year old man of Sullivan crashed into the back of it.  Two school buses carrying high school band students then slammed into that wreck.  A 15 year old girl of St. James, was killed when she was in the back seat of the first bus.  Charges will probably not be filed against any drivers until the final patrol reported is completed which may take up to six weeks.

Investigators are hoping to discover some information that will make school bus travel and road construction zones more safe.  Summer is a busy time for road construction and wrecks are common in work zones. The Missouri Department of Transportation is doing work on 250 bridges and improving 5,600 miles of roadway.  Accidents continue to happen in spite of their safety education efforts, signage, stricter penalties and fines for construction area violations.

  Two Die On I-70 Near Highland, Illinois

Two crashes invovling tractor trailers, about two miles a part, claimed two lives on I-70 near Highland, Illinois.  In one of the crashes a pickup truck was sandwiched between two tractor-trailers possibly resulting from a slow-down from another crash ahead that took place about 10 minutes before.  One of the drivers of the tractor trailers was unable to escape when his tractor trailer caught on fire. A crash had occurred approximately 10 minutes prior on I-70 further westbound involving a tractor trailer cabin and trailer veering off to opposite sides of the highway, dumping boxes of food across the median.

Police report that a third accident occurred with a tractor trailer and a motorcycle.  The motorcycle crashed into the back of the tractor trailer, causing  injuries to the motorcyclist.  Traffic was backed up for hours and Highway Patrol was redirecting St. Louis bound traffic.  The identity of the victims has not been released.

  Semi Trucks Crash Killing Cattle & Costly Property Damage

Sixteen of 34 cattle survived a two semi truck accident last night at about 11:50 p.m.  One driver was talking to another driver on his CB radio when he crashed into the rear of the box trailer. Upon impact, the truck caught on fire and the driver dove out of the driver's side window that was partially down. The driver was unable to extinguish the fire that caused the trailer tires to explode and blew the bottom out of the aluminum cattle hauler. 

The driver of the other truck, a Volvo semi-box trailer was not seriously injured nor was the driver of the cattle semi. However, the cattle truck, a 1999 Peterbilt semi was a total loss as were some of the cattle.  The driver of the cattle truck was cited for driving too closely. As well, westbound and eastbound traffic on Interstate 94 were closed for most of the night due to several cows running loose and officials afraid they cattle would jump the three foot median.

  Woman Dies in Horrific Accident, "Texting" a Possible Contributer

A 21 year old woman crashed into a semi truck and was ejected from her car when she was then struck by a second tractor trailer on Sunday afternoon.  Officials pronounced the woman dead at the scene.  A witness reported that they had seen the woman texting just before the crash.  She lost control of her 2000 Oldsmobile Intrigue and left the highway, striking a guardrail. She then spun back into the highway and struck a tractor trailer. After crashing into the first tractor trailer, she was thrown from her car and then struck by the second tractor trailer. The crash remains under investigation and due to the damage to the car, it cannot be determined if she was wearing a seatbelt. However, her phone has been recovered for investigation as to time and use to determine if "texting" was a contributing factor in the horrific accident. No  reports were made in regard to the injuries the drivers of the tractor trailers may have sustained.

  Two Injured in South St. Louis Crash

Two people were seriously injured after the car they were in crashed into a yard in south St. Louis.  Police report that the car collided into a truck before crashing into the yard.  Emergency personnel had to cut the car to remove the driver after the auto accident.  The driver and passenger were taken to a local hospital.  Their current status has not been released.

  Truck Driver Charged with Homicide with by Vehicle

A truck driver has been charged with homicide by vehicle in a deadly five car crash on Route 209 in Monroe County, Pennsylvania, that has killed one and left several others with catastrophic injuries. Last Thursday evening four vehicles were stopped at a red light facing northbound when the tractor-trailer traveling northbound in the right lane failed to stop and crashed into the back of a Mini Cooper. The Mini Cooper then struck a Chevrolet Corvette and then crossed the intersection and crashed into a guard rail.  The Corvette was pushed into the left lane and collided with a Chrysler 300. After striking the Mini Cooper the tractor trailer then continued straight and hit a Hyundai Santa Fe. The Hyundai was shoved into the intersection and the tractor trailer veered off the road and crashed into a traffic control pole and caught fire. The traffic control pole then fell on the Hyundai. The driver of the Hyundai and her passenger were air lifted to an area hospital.

The truck driver was arraigned on charges of homicide by vehicle, following too close, and careless driving.

  Driver Going Wrong-Way Crashes Into Tractor Trailer

A driver traveling in the wrong direction on I-70 crashed into a tractor trailer this morning near Kansas City. The driver was traveling west on an east bound lane.  Missouri Highway Patrol drew blood from the driver to check the driver's blood alcohol level, however, it is unknown at this time if there will be charges. The driver sustained injuries in the collision with the tractor-trailer and I-70 was closed for an hour for auto accident clean up.

  Illinois Truck Accident Kills Three and Involves Nine Vehicles

A chain reaction multiple car and semi accident occurred on Interstate 57 and three women were ultimately killed last weekend. According to the Illinois State Police several cars were slowing down to merge into one-lane traffic when a truck driver apparently got distracted and did not realize how fast he was going. He crashed into a Trailblazer, collided with several other cars and set off a chain reaction that involved nine vehicles in the fatal auto accident. The three women killed were all in the Trailblazer and were from Mississippi and on their way to visit an Illinois Amish community. They were almost to their destination when the multi-car and semi truck accident occurred. The accident happened about 135 miles east of St. Louis and 65 miles west of Terre Haute, Indiana.  When the local emergency teams responded to the scene they discovered that three of the four women in the SUV were dead. After being rear ended the Trailblazer went off the road and burst into flames, the driver sustained serious burns. An Equinox was also involved in the accident and was so destroyed that some oberservers thought it was upside down as they could not tell where the wheels A woman and her daughter actually were removed or crawled out. A woman sustained serious injuries, but the 11 year old daughter apparently crawled out and was walking around. Thirteen people were injured in the accident, two of which were critical. The interestate was closed from 5 p.m. until approximately 1 a.m. while road crews cleaned up the accidents.

  Train and Semi Crash Injures Four

A train and a semi-truck collided on May 14, 2010 in Michigan, and investigators are trying to determine if it was caused by driver error or malfunctioning railroad signals. The violent crash resulted in four people being injured. The train conductor, conductor assistant and an engineer were on board the locomotive at the time of the crash and the 59-year old driver of the semi-truck was alone.   First St Louis Auto Crash Fatality in May

A  St. Peters man was killed in an auto accident on Interstate 70 when the Dodge Durango he was driving was struck by the wheel of a tractor trailer.  Equipment failure caused the truck to lose two wheels from the rear axle. The wheel struck the front windshield of the victim's  Durango. After the collision, the Durango then traveled to the right and struck the side of a Nissan Altima in oncoming traffic on I-70. The driver of the Nissan was transported via ambulance to a hospital with minor injuries, however, the St. Peters man was pronounced dead at the site.  While this is the first fatality of May, it is the 44th  highway fatality of the year in the St. Louis area.

  Four Vehicle Crash in Illinois

A woman sustained serious injuries after colliding with a tractor-trailer in a four-car crash in Illinois last week. The woman was traveling northbound in the southbound lane of I-255 when she crashed into a tractor-trailer. After colliding with the tractor-trailer, she was struck by a van and a SUV that were traveling southbound on I-255. The woman was charged with drunk-driving, failure to reduce speed, and improper lane usage. The woman and the driver of the van were transported to the hospital.

  Wrongful death suit filed against sod company after employee kills woman in accident

The widow of a woman killed in an accident involving a sod truck testified in a wrongful death suit last week, claiming he has yet to recover physically or emotionally after losing his wife of 33 years in the tragic wreck.

The plaintiff, age 64, filed suit against the defendant, a sod company, for the negligence of the company's employee. Police reports indicate that the driver failed to stop his fully-loaded truck at a stop sign, and he was speeding, traveling around 50 mph, when he struck the plaintiff's car with his wife in the passenger seat.

  Dump truck plows into motorcycles, kills 3

According to the Associated Press, a group of eight motorcycle riders was stopped at an intersection when a dump truck failed to stop and plowed into the back of the group, killing three riders.

Some of the bikes caught fire under the truck while others were scattered behind it.  

So far, no details have been released on why the truck driver failed to stop.  He could be held liable for damages to the injured riders and the victim's families if found to have been negligent or reckless.

  Trucker responsible for accident that killed boy

A father and son were involved in a tragic accident last week when a semi truck them while crossing the street.  

The 6-year-old boy sustained fatal injuries, while his father was treated in critical condition at a local hospital.  According to Police reports, there were no stop signs, stoplights, or traffic control at the intersection, but no information was released on why the trucker failed to stop.  So far, he has only been cited for striking a pedestrian.

  Family files $5million suit after truck accident

The family of a bicyclist who was killed in a collision with a truck filed a wrongful death suit for $5 million against both the trucker and his employer.

The accident occurred when the victim was riding his bicycle behind the truck.  When the trucker turned right, the victim became caught in the truck's rear wheels, killing him instantly.

The suit alleges negligence on behalf of the driver because a surveillance video showed that the driver failed to use his turn signal or ensure the road was clear of traffic, cyclists, and pedestrians.  The video also shows that the biker was following proper bicycle laws, and that the trucker did not even stop after running the victim over.

  Arizona Truck Accident lawsuit settles for $600,000

In Arizona, the parents of a college student killed by a semi-truck and the trucking company who employed the truck driver reached a $600,000 settlement earlier this month.

The accident occurred about an hour north of Phoenix when the victim ran over a dead elk that was lying on the road.  When he exited his vehicle, he was struck by the truck and killed instantly.

Although the police report found the trucker was not at fault, the plaintiff's attorney hired an accident reconstruction expert who concluded that the trucker had about 5 to 6 seconds to see the victim before hitting him but failed to apply the brakes at all.   This along with the trucking company's record of inadequate driver performance and history of pushing regulatory limits imposed on truckers motivated the defendant to settle with the family.

  Semi truck driver caused fatal accident while watching movie

A tractor trailer driver caused a fatal accident last week, and subsequent investigations revealed that his log books had been falsified and he had been watching a movie at the time of the crash.  

The driver admitted to police that he had been on duty for more than 27 hours prior to the accident and was watching a movie on a laptop when he struck another vehicle that was disabled on the road.  The driver of that vehicle died as a direct result of her injuries in the crash.

  Federal law bans texting for truckers and bus drivers

The federal government has banned texting for drivers of all large trucks and buses, with the hope that the new legislation will prevent deadly traffic accidents.  The new law went into effect immediately, imposing fines of up to $2,750 for violators.

Research that fueled the legislation cited studies that found heavy vehicle and truck drivers were 23 times more likely than a non-distracted driver to have an accident while texting and nearly 7 times more likely to crash while reaching for or using a cell phone.

  Semi-truck accident kills toddler, injures rest of family

A tragic semi truck crash in Georgia killed a three-year-old boy and severely injured the rest of the family when their minivan was rear ended.

  Madison County mother files suit over accident caused by tractor trailer

A Madison County, IL woman filed suit earlier this month after she and her daughter sustained serious injuries in an accident involving a tractor-trailer.  

The accident occurred on I-270 when the plaintiff had stopped due to traffic. Failing to stop his truck in time, the defendant struck the vehicle directly behind the plaintiff with enough force to push the plaintiff's car forward into another truck.

In the 4-count suit seeking over $200,000 in damages, the plaintiff alleges that the driver of the truck was negligent by driving too fast and failing to stop to avoid an accident.

  Brothers file suit against trucking company and drivers involved in fatal crash

The brothers of a truck accident victim have filed suit in California this month against four trucking companies and the drivers involved in a fatal truck accident in November 2008 for the wrongful death of their father, younger brother and two others.

According to the suit, the brothers alleged that one of the defendants was driving a tractor trailer and rear-ended the victim, pushing his vehicle under the rear of another semi-trailer.  Everyone in the vehicle was killed.

At the time of the accident, a dust storm had made visibility more difficult, and the suit alleges that tractor trailers should have been off the road that morning due to repeated broadcasts of the storm warnings and cautions of reduced visibility.   Eight vehicle truck accident kills one

  Hit-and-Run truck driver still on the loose

Texas Police are still looking for the driver of an 18-wheel gravel truck that failed to stop after an accident last month that killed a 5-year-old girl.

According to newspaper articles, while on the way to school, the little girl was asleep in the back of her mother's Camaro with her brother.  Suddenly, the truck collided with another vehicle in the oncoming lane, causing it to spin into the driver side of the Camaro and strike the vehicle precisely where the young girl rested her head.

The victim's mother said she saw the truck drive away as she attempted to help her daughter, but among the chaos of the wreck, did not get a good enough look to identify it. 

Police investigators believe the gravel truck had attempted to swing out in front of the Mercedes from an outside lane, and the rear of the truck clipped the front of the Mercedes, which then caused it to hit the Camaro. As a result of the impact, the victim suffered a skull fracture and died at the hospital with her parents by her side.

  Illinois tractor trailer accident kills one and injures another

An accident in Illinois involving a tractor trailer and a pickup truck took the life of a young teen who was riding in the truck and sent the young driver to the hospital.

According to Police reports, the driver of the semi truck lost control and spun into oncoming traffic, striking the pickup truck.  The trucker was not injured.

The two teens in the pickup truck were both basketball players at a local high school, and the accident has shocked the small town and demonstrated the destructive power of tractor trailer accidents.  Both of the teens were wearing seat belts, but the force of the tractor trailer left little chance for the boys to avoid injury.

  $49 million verdict for truck accident lawsuit in California

  Woman killed in accident involving dump truck

A New Jersey woman was killed last week in a car accident involving a 2008 Lincoln and a dump truck when the driver of the Lincoln crashed into the back of the stopped truck.

  Tractor-trailer accident kills mother and two daughters

A fiery head-on collision with a tractor-trailer this past Tuesday took the lives of a woman and her two daughters, ages 4 years and 12 weeks.

Witnesses who saw the tragic accident reported seeing the woman's car cross the center line of a two lane highway, right into the path of an oncoming tractor-trailer.  The car then burst into flames, sending bystanders running for fire extinguishers.  

Once the flames were put out, a witness who stopped to help told reporters he cracked the back window to let the smoke out of the vehicle.  That was when he and the police saw the two girls in the back seat.

The witness's wife, a registered nurse, began giving the baby chest compressions, but unfortunately the infant and girl sustained fatal injuries and were pronounced dead at the hospital.

Police are still investigating the accident, and no charges have been filed.

  Truck Driver sentenced for fatal accident

As reported in a Maine Newspaper, a truck driver was found guilty for leaving the scene of an accident last year after losing his load of wood beams from his trailer, killing a motorist.

While driving on a winding section of road in January 2008, the trucker lost the beams which then struck a man's vehicle.  The trucker claims he did not realize he was involved in an accident until he returned to the scene looking for his wood.  He saw the emergency vehicles, but said firefighters blocked him from accessing the road.  

When asked if his load could have caused the accident, he told officers no.  The Assistant District Attorney stated that by not cooperating with the investigation, the trucker failed to "right his wrong."  

Although the trucker admitted his mistake in not owning up to his role in the accident initially, he insists he never intended to leave the scene.

  New York tow truck driver hits car while on two cell phones

Earlier this month, a New York tow truck driver admitted to police that he had been texting on one cell phone and talking on another when he crashed into a car driven by a 68-year-old woman with her niece.

  Motorcyclist injured in accident involving semi truck

Last week, a traffic accident in Pennsylvania involving a semi truck and a motorcycle left one man injured after being dragged nearly 15 feet under the front bumper of the truck.

At the time of the accident, both vehicles were waiting to turn left at an intersection.  The driver of the truck claims that he did not realize he hit the motorcycle from behind until he noticed several bystanders waving in attempt to get his attention.

  Missouri truck driver fails to stop in traffic, kills 10 people in Oklahoma

A Missouri truck driver had a clean driving record up to last week, which was one of the reasons the State of Missouri renewed his commercial driver's license this past April.  Now, authorities in Oklahoma are trying to figure out why the driver did not stop, nor hit the brakes, last Friday when he slammed his big rig into a line of vehicles slowed on a turnpike.  The accident killed ten people.

Because of the accident, the trucker could face ten separate misdemeanor homicide charges that each carry a 1-year sentence.  

Although alcohol was not reported as a factor, investigators have not found a reason why the trucker failed to stop.  Furthermore, an initial report concluded that he was traveling at an unsafe speed for the traffic conditions.  Therefore, it is likely he will face criminal charges as well as civil action on behalf of the victim's families.

  Maine doctor killed in car crash involving 18-wheeler

A fatal car crash involving an 18-wheel tractor trailer in Maine last week took the life of the occupational health director at a hospital in Sanford.

According to Sanford Police reports, the doctor was killed late Tuesday afternoon when a truck struck her SUV on the driver's side while she attempted to make a left turn.  

The Police chief claims that obscurred vision due to a hill could have contributed to the accident, believing the truck crested the hill just as the doctor made the turn.  The crash remains under investigation with no charges filed as of yet.

  Tow truck causes four-car accident on interstate, kills one

This past Saturday, a four-vehicle accident involving a flatbed tow truck on an interstate outside Salt Lake City took the life of one man and stalled traffic for three hours.

The tow truck was southbound on I-15 and cross over a movable barrier, slamming into a northbound Toyota Camry, Chevy pickup truck and a Honda Element SUV.  The Camry became lodged underneath the tow truck, sending the driver to the hospital in critical condition.  The driver of the SUV was pronounced dead at the scene, and the two passengers of the pickup truck escaped major injury.

Initial Police reports state the accident was due to the tow truck driver "not paying attention."

  Motorcycle-Semi accident kills soldier

Last week, a tragic accident involving and motorcyclist and a semi-truck took the life of a special forces soldier.

  Illinois proposal to raise speed limit for truckers gains both support and criticism

Illinois lawmakers are once again putting forth a bill to the state governor that would raise interstate speed limits to 65 miles per hour for truckers, the exception being in Chicago and surrounding areas.  Put forth three times already to ex-governor Rob Blagojevich who vetoed the measure, lawmakers passed the bill quickly this time to get it to Rob Quinn's desk.

Although the bill seems like a simple concept, it has created quite a safety debate over the benefits and risks of allowing truckers to travel the same speed as other drivers.

On the one hand, slower trucks cause traffic congestion, which increases the rate of accidents between trucks and fast-moving cars. 

On the other side, however, are critics who say that trucks are already driving well-beyond the current 55 mph limit, and that increasing it to 65 mph would only encourage truckers to drive even faster. This obviously raises a major safety concern for other drivers since semis have a limited stopping speed and have the ability to cause catastrophic damage in accidents due to their weight and size.

As of now, Governor Quinn has not yet stated where he stands on the measure.

  Semi-truck accident kills three

Over the weekend, a tragic accident in Phoenix involving a Cadillac sedan and a semi-truck took the lives of three people, two adults and a one-year-old, when the truck driver failed to stop at a traffic light at an intersection 

According to the Phoenix Police Department, when the truck went through the intersection, it T-boned the Cadillac, killing the front-seat passenger and the one-year-old girl in the backseat upon impact.  The driver and the other passenger were taken to the hospital immediately, but the driver did not survive.  Currently, the female passenger remains in critical care.

According to preliminary reports, the driver was not impaired and criminal charges have not yet been filed.

  Two Chicago families get $24 million for fatal semi-truck crash

  Woman awarded $65 million for injuries sustained in truck accident

This week, a jury in Polk County, FL awarded a 21-year-old woman $65 million for her injuries from a 2007 accident with a tractor-trailer. 

Prior to the crash, Kendra Lymon was studying psychology and could speak six languages.  While in school, she also worked for the Florida Institute of Neurologic Rehabilitation as a residential aide.

Now, she relies completely on family and friends to help with basic daily tasks such as showering and eating, and she has difficulty speaking at all.

  Truck accident suit in Illinois settles for near $1.5 million

This week, a Chicago wrongful death attorney settled a suit regarding a semi-truck collision that killed Debra Cunningham of Danville, Illinois for $1,495,000.

Cunningham died in August of 2004 when a Dayton Freight Lines semi-tractor trailer collided with her vehicle at an intersection.  Henry Butler, the truck driver, failed to yield to a non-reflective stop sign the city placed in the intersection after a severe thunderstorm knocked out the traffic lights. 

Witnesses said that Cunningham had come to a complete stop, and after proceeding through the intersection, was hit by the semi.  She died from the force of the impact.

  Wrongful death suit settled over bus crash fatality

This week, the Huntley Project School District reached a settlement with the parents of a 7-year-old girl who died in a bus crash last year.  Sarah Fark, an elementary school student at Huntley, was riding a school bus when it pulled in front of an oncoming pickup truck. 

Tuesday, the school board of trustees voted to approve the settlement, but did not release details to the press.  According to the school's superintendent, trustees did not know the terms of the settlement until it was time to vote at the executive session on Feb 10.

The bus driver pleaded guilty to careless driving and failure to yield.  She received a six-month suspended jail sentence.

  Trucker's speed caused deadly pileup in tunnel

Originally, when trucker Jose Reyes caused a chain reaction collision in the 5 Freeway tunnel in California in 2007- causing three fatalities and 23 injuries- prosecutors did not file vehicular manslaughter charges because a report claimed that Reyes truck had a faulty right-front brake.  The California Highway Patrol investigated the accident and initially stated that the leaking wheel-bearing seal on the steer axle reduced braking efficiency, which could have caused an imbalance when Reyes hit his brakes. 

Since prosecutors found that Reyes' employer was responsible for the truck's maintenance, they did not feel it was necessary to press charges against the truck driver.  However, in a newly released report by the CHP, further investigation uncovered evidence that Reyes was driving in excess of 65 mph on the rain-slick freeway.  The speed limit was 55 mph.  This new finding has the CHP convinced that Reyes' speeding caused the truck's initial loss of control, not the brakes. As a result, the truck crashed into a concrete barrier, causing a multiple car collision, which killed a 6-year-old boy and two adults. 

CHP officials state that the brake system may have been a contributing factor, but not the cause of the accident.  So far, the district attorney's office claims it has not filed any charges against Reyes.
