A San Antonio man died last week in a car accident after he attempted to pass another car on the right, injuring both his passenger and the driver of the other car. After the man’s SUV went off the road, he lost control and swerved into the path of the pickup he was attempting to pass. The two cars collided, and the SUV continued across the highway and hit a ditch, causing the SUV to flip several times. The driver of the SUV died at the scene, but his passenger was taken to a local hospital in critical condition. Fortunately, the driver of the pickup sustained only minor injuries. Due to the nature of the accident, the passenger and pickup driver could have a claim against the driver’s estate if he is found to have been negligent or reckless.
